There will be a question of where damages will come from.

If they prove this was misrepresentation the E & O insurers may not cover.

So that brings in the scenario which I will not mention here.

So agreed it may be difficult to recover damages awarded at the end of the day.

Its what damage this continues to cause may well affect viability to perform.
