Olddog: We must have been typing about the same time. Based upon your listing of ZTE's affirmative defenses and counterclaims and knowing now what was tried to the jury, I'm guessing ZTE has abandoned all of it's affirmative defenses except #. 2 and all it's counterclaims except #8.

I'm making this assumption because courts will not try those issues separately and since there was not any evidence presented by ZTE to support those defenses and counterclaims and since there was no jury charge on those items, we have to assume they were abandoned or lost in pre trial.

If I'm correct, this is good news for IDCC as we seem to have won on those stock laundry list defenses that the defense bar has concocted over the last few years.
