THere is not a separate NDA with respect to the TC lease, aside from a clause that states that both parties can't share confidential testing data, but not with respect to a potential deal or anything aside from the actual testing data. STWA filed a more extensive NDA agreement with respect to the Kinder Morgan lease.

So there is no reason why the company should be able to hide behind the NDA aside from the actual testing data.
