Thanks for your input..I am of the opinion that IDCC's latest request for "Interim Awards" provides them with several "BITES at the Apple"..Both InterDigital and the ICC can now remedy the Nokia attempt to denigrate all ICC Arbitration Contracts, with their frivolous Appeals and attempt to create new Arbitration Law..by awarding extensive, and specific Punitive Damages for failing to comply.Nokia will not delay with Appeals while extensive Monetary damages are being compounded..The ICC does not need or relish this attempt by Nokia to make a travesty of ICC Arbitration..as Arbitration #2 is Nokia vs. IDCC and the ICC!

I am not a fan of an arbitration panel playing with the same real estate again. I do not know what the ICC will do with this one. It would seem logical to me to reconvene the first Tribunal. However, such an action could be viewed as an admission that the ICC fumbled the ball in the first arbitration. This matter is a mess that can be cleaned up rather quickly by an affirmation from the 2nd Circuit. I would much rather have Nok in the SDNY complying with the terms of a "turnover" order than some mandate from an arbitration tribunal. The selection process of three arbitrators, their review of the entire first arbitration file and sending their findings to the ICC for further review is both physically and mentally exhausting for me. Sorry I do not feel I am much help to you on this one.
