Patent Claim = Statement of Fact, right?

Seems to me that this is the = of Capone's tax evasion blunder used by the gov't to nail hm. By making this false statement of fact, it seems that the SEC has something to sink their teeth into his arrogant butt. Can't hide behind safe harbor when claiming something as historical fact when it is not.

SEC, where are you? Maybe they are in Arizona, which is why Ziego is not?
