Ghors--Without belaboring the point, the difference is that there are the Federal Rules of Appellate Procedure and the local rules that each Circuit promulgates which may alter the Federal Rules. I believe that your posts on Nokia's oral argument relied on the general Federal Rules of Appellate Procedure where parties have to file to seek oral argument. The 2d Circuit Handbook and the Second Circuit Local Rule, which olddog just posted, does show that oral argument is premumptively allowed unless all 3 judges on the panel agree that it is not necessary.
