David, my point of this piece not being very well written on purpose to allow for gray area such as monies coming into the trust for almost any reason. If I knew over three years ago there would never be any third party suits not including the D&Os, then Susman knew from the "get go" as well. All of the delays were nothing more than to kill time in order to get past the P&AA expiration period. Of course, as time goes on we see things we could not in the beginning.
