Will they be a startup next year too?

It doesn't look that way to me, but ICBW.

But the future wasn't what was being discussed. It was the past. The fact that "OPM" was being used to run the business.

The company has always been upfront about the fact that Wave Systems is a development stage company. Wording to that effect has been present in every one of their annual reports that I have ever read. Check it out yourself.

Anyone that has invested in Wave Systems that didn't even do enough DD to learn that fact is a fool.

Investors who knew that fact going in to this investment also knew the risks inherent in speculating on an unproven concept.
They were adults making choices. Their decisions will be proven to be good ones, or not.

There are no guarantees of success, and nobody is here under duress. Sell or hold, or buy some more, the choice is there every minute of every day that the markets trade.

But what can be said of investors who invest in a development stage company and then complain about the fact that the company is using the stock market to capitalize the company?

Unclear on the role of the equity markets?
