Amarin should consult a proper judge answering if in its situation - in which the last denial was decided after counsulting the superior levels of FDA (the ones Amarin has to appeal to if it decides to go further with the appeals) - a civil suit can be accepted without a completion of the appeals thread.

The answer is almost certainly no, I think they would have to prove corruption or bad faith in the appeals process for that to be allowed which in the absence of a smoking gun would be almost impossible.

It might also be possible if the FDA stalled the appeals responses long beyond their legally allotted times (I think at some point this becomes bad faith on the FDA's part).
