Thanks for the heads-up on this new development. The Stanleys had gotten Charlotte's Web reclassified as hemp several months ago, so this decision of theirs to attempt shipping to all 50 states is a logical outgrowth.
The economics of CBD oil from Charlotte's Web vs. CannaVest's RSHO and MJNA's Raw CBD oil seriously favor the CWeb oil, since the Charlotte's Web strain has 15% CBD in the raw oil, whereas the oil from industrial hemp is 3% CBD in its raw state (per HempMeds). The processing required to raise the CBD to 15%, plus the sheer amount of industrial hemp required to make the refined oil means that the CBD from MJNA and CannaVest retails for $0.30/mg vs. $0.05/mg for the oil derived from Charlotte's Web.
This would severely impact CannaVest's business model, and make RSHO nearly unsaleable in the US because of the huge price differential. This, of course, would also impact the Raw CBD Rich Hemp Oil that MJNA is selling for $439 via HempMeds.
Realm of Caring will have to deal with the legal issues because of the CBD from stalks only loophole in federal law that MJNA and CananVest are operating under, but I can see them working through that in a couple of ways:
1) The passage of House Bill HR5226 (Charlotte's Web Medical Hemp Act of 2014)

2) A battle in the courts, where the Stanleys and RoC will argue that their oil has CBD as high as legal products like RSHO, but lower THC. CharWeb oil actually meets the spirit of the law better than RSHO, because the process that raises the CBD percentage in the refined oil from industrial hemp also raises the THC level to that beyond what would be legal to import.
And considering the fact that this oil is being used by kids with a debilitating disease, I see one strategy or the other working.
MJNA and CannaVest thought they would have a large window of time to profit from the industrial hemp loophole, but that window is rapidly closing.
