And yet,May 2000 Mr. Chris Kitasaki, Esq., an SEC attorney working on behalf of DFMI/DFI saw something wrong between both companies.Then,on August 1, 2000, during a meeting with Mr. Kitasaki,"he suggested" that a rescission letter to remedy the problems of DFMIs corporate structure and the possible tax consequences to the shareholders be drafted and issued to all shareholders. Furthermore, "he suggested" to dissolve the DFMI corporate entity and use DFI.For some reason,Larry Panik decided to go with DFMI,why? That's the million dollar question??

Maybe we need Mr Kitasaki to be called in,and we should ask him,what he saw!!.

Then the court/Judge Ellsworth called it a "addendum" and you call it (IMO) it's in the minutes as a "addendum" and it WASN'T SIGNED in order to be legal,so there's "no confusion","not fraudulent"!!.
The Defendants lawyer even said,well your honor,it could of happen.When asked about the signing...And TMMI was in partnership with Iterated in bringing fractal compression to video. Iterated was only working with still images before kramer's creative mind,with TMMI/MCI bringing $40,000,000 to the table!!. (VDK 1.0-1.4 is what came through DFI) No ifs ands or buts about that!!. There's not a Jury in this country,that will see it any other way,and by the time this case goes to Jury Trial,the Defendants will be over 2 1/2 years without being able to use the codec in question and by that time,if they did pull off some miracle;The damage will have already be done!!.The missing link for the Defendants,

"The Unsigned Addendum" a "TRAGIC FLAW" in this case,for Larry Panik,as well as the 29 plus shareholders!!. TMM,Inc is in a partnership with Raytheon,and this lawsuit,is just a small stepping stone,of what will be coming for TMMI and their shareholders...... I think 51% Plaintiffs 49% Defendants!!.
We can argue about this case,until the cows come home but,you would be wrong!!.
