Hey Blue, no lawyer here but because the BoD has changed significantly over the past year and the phishing has just begun it seems to me that any allegation would be against the present Board which appears to be meeting their fudiciary reponsibility. But what do I know? Flip side, I've always believed the old -long term "crony" - Board never came close to meeting it. No way, no how. So if the suit is going backward and there is no time limit protection for that BoD then I'd bet there is a case to be made, individually and severally. My opinion w/ the obvious caveat that I'm not an attorney. Of course it is also important to note that Wave has insurance to protect their board members against such suits.
