Using words like "uphill battle", and "positive or negative" in regards to dealings with the FDA would not be used if there is a compromise going on between the FDA and AMRN to settle this manner. There would be no continued threat of seeking "judicial relief" made publicly if there was a compromise currently going on. Less would have been said, and if there was a compromise currently being discussed, a comment along the lines of "we has communicated with the FDA and there is no update to be made on this matter at this time" is all that would have been needed. No more no less.
