he original goal was so that commons could participate from day #1 -- in a 25% capacity. Otherwise, commons would not have been able to participate until preferred (including TPS) were paid in full face.

Maybe so, but I would think that since it was a mediated process any thing could have taken place. They could have let commons in without removing the cap. I still see it as a positive.
