And what if we had tried and won but then appeals tied it up for years and years?

Sometimes one picks their battles and keeps the focus on the broader war. And sometimes diplomatic solutions are the best way to go.

Remember--IDCC had basically already tried the case against MOT and much of what was in dispute was basically the same IP. The strength of those patents vs current patents is a factor that I don't think you're considering.
