More likely senario...

when the evildoers were in charge back in the day there were more scams than previously thought. This is probably specious former "insider" debt. Maybe related to the loan without repayment terms or something else completely different.

Current management may not know enough about the debt on the books to know if it is related to fraudulent dealings from insiders of many years ago.
