Nothing new here, Nok just trying to put forth new evidence after the evidentiary hearing and discovery was closed. The remand from the CAFC merely stated that Nok may try to raise its alternative in the 613 investigation. If they had wanted the evidence reopened, they would have used the word "shall". Judge Newman continues to dissent every chance she gets. NOk had all of this evidence during the investigation and opted not to present it during discovery or at the hearing.
