Do you or do you not believe WAMu was solvent on 25 september 2008? WaMu was seized because it was declared, 'unsafe and unsound' by the OTS. Solvent or not isn't really the issue, nor any of the legal standing by which the OTS has their regulatory authority. Taking it one step further, the seizure was not challenged by the debtors, and the window of opportunity for that challenge is long gone. It was like the first 30 or 60 days... That's in the statutes giving the OTS authority to seize as regulator.

So when FDIC concludes after 6 years that WaMu was solvent (=more assets than liabilities) you don't consider that an issue???
