If ALJ Essex ignores the technical prong for -613, it puts him in the unenviable position of requiring "articles" in one investigation and not in another.

Since the CAFC opinion in 2010-1093 was precedential, should it not apply to ALL 337 investigations involving licensing? If so, the ITC's unique interpretation of the CAFC opinion on 841 becomes the ITC precedent which should apply universally.

Either way, whatever the ALJ and the commission decide on the remand, another appeal is inevitable. So Nokia-Microsoft can extend their free ride for another 2-3 years!
