Erm.....no, they validated that the SPA was mishandled, not the AC, and although the AC essentially led to the SPA being rescinded, they're two separate issues. Not sure Congress wants to dip their hands into the mess the AC process has become.

why not file a CP demanding it be vacated entirely?

A grand idea, but has such a thing ever been attempted before? And wouldn't a SPA CP have the potential to delay the appeals even further, meaning it might be counterproductive to file one?
