Now can someone please tell me if this is too many strikes?

Strike 1. Product took 3 to 4 weeks to arrive
Strike 2. Opened the case of yella and purp(which was packaged decent) and the cans looked as if they had fallen out of an aiplane.
Strike 3. Noticed right away that it was 8 months past its expiration date
Strike 4. Called his direct number which is 1-318-791-3765 and left a message stating this fact in which he replied with a text message(which i’m sure you have seen if not look back at my posts) stating that the purp was made last week, didnt have an exp date on it because people couldnt understand exp dates and the yella which clearly shows an exp date on the bottom of 06/28/13 was an error by the “bottler”. So he said to email him and he would prove that the bottler messed up.
Strike 5. After emailing him several times he never responded to my request to prove that the exp date was incorrect due to a printing issue.
Strike 6. Knowingly shipping a product out with melatonin in it that was expired.
Strike 7. Knowing that the FDA was changing the rules and doing nothing about it.
Strike 8. And best of all not responding to the FDA warning letter immediately!!!!
