The DOJ's time is up to provide discovery, so we will see what proof there was that they dumped anything, hopefully on April 8.
But whether they did or not has no bearing on whether there are also counterfeit shares.
We are asking for proof. You are asking me to provide proof so that I can receive proof. There's a paradox in there somewhere.
If Judge B orders the share accounting, whatever the outcome I will be able to handle the truth.

That PR was a joint effort but I had a part in writing it. Maybe the professionalism doesn't come up to your standards, but the heart and soul of the message is that shareholders want to know the truth.
If you want proof that you have been correct all along, that there are no counterfeit shares in SPNG, then you should be standing on your head demanding a share accounting yourself.
I suggest you submit an expert opinion letter to Judge Bernstein, yourself.

Amen to that RD. This is kind of like supporting the troops, even if you don't support the war.
Everybody here is either a shareholder and/or makes spongetech part of his daily life. Anybody THAT involved should want to see justice served to creditors and shareholders.

Patch, Everyone with any common sense knows that SM meant 500mm. You may bring that up all you want but 500mm for a company, within 2 years of selling products is better than any other you can show us. You, and all other disgruntled people, will never change the facts! Please stick with the facts of how well the company is doing. That, in the end game will tell the whole story. When the K and Q comes out the game is over. I would like to know what you will do after that. Please think more about your about your fellow man than what you can get from them. Great post, bkc. There are many, many of us who are silent, but who believe that a terrible crime has been committed against Spongetech, one of many small companies who has tried to succeed. Hopefully, today will be the beginning of the end of the sickening waves of lies and distortions perpetrated against SPNG management.

Hi Risk, going to use your post to re-post Doug's 10/3 FINRA message.
It is important to note that today's PR from the company about the FINRA extension request was a mandatory disclosure.
The company needed to provide FINRA with a minimum two week notice if it desired this request and was also required to notify shareholders of its initiation.
Note that in these times of heightened scrutiny it is imperative that the company follow the letter of the law and also be careful not to embellish any public releases.
Also please note that this DOES NOT NECESSARILY mean that the company will not make its filing prior to the original time. It merely means that they have made a prudent decision to allow for any worst case scenarios that may cause a delay that they are current not anticipating.
Everyone is rushing to judgement about things and seem to be quick to draw conclusions based upon worst case scenarios. Note that such may not be the case.
Also note that nothing in today's release alters ANY of the company's underlying fundamentals nor does it necessarily portend anything bad to come.
It is merely planning ahead in case extra time may be needed.
If you choose to believe in the worst case scenario then that is certainly your own choice to make. But it is not the only logical conclusion that can be drawn from today's PR.
If you sit back and take a deep breath I think that you can see there is a logic behind this that clearly can allow for a positive outcome.
I just hate to see people rush to judgement on matters that are not necessarily cut and dried and lose money as a result of hasty decisions.

As you will see they are often wrong and despite their best efforts to try and convince eveyone that SPNG is a scam and will never amount to anything, if you are objective and choose to do your own thinking, you can easily conclude that things can easily work out for the best.

That sure is a convoluted way to run a scam. Don't scammers normally sell shares to line their pockets?? What a waste for SPNG to sell shares and buy advertising. Because then, whoops, what happens? People see the ads and want to buy the merchandise. And then poor SPNG has to actually manufacture product and deliver it to 40,000 doors. And soon even to 100,000 doors. And then they have to deal with the 100 or so employees they have, secretaries and packagers, research scientists, marketers, salespeople... some in a 10-year leased 6500 sf space on W. 33rd St. and 70 or so others in a rather large facility in Georgia. And a few in their office in Germany.
Somebody needs to tell management they're supposed to be buying Ribovitchs and Park Avenue penthouses with all that scam money.

SPNG gets a research and development facility, manufacturing space, Dicon's products and very importantly now owns its technology patents. No way anybody can put a negative spin on owning Dicon.
The contact certainly did not state that D&T were not advising SPNG in a consulting capacity, he merely stated that they were not the auditor of record until FY 2010. But, we can for sure sicc Old Tymer on him (if he hasn't already called LOL).
Otherwise, my belief is that anything printed in the NY Post about SPNG is bogus and a blatant attempt initiated by short sellers and their minions to avoid covering a massive short position. Which, by the way, I believe you are very aware of.
So you are indeed referencing the NY Post for your "proof." D&T are the auditors of record for fiscal 2010, period.
If your reporter is Kaja Whitehouse, then your credibility is already shot from the get-go.
SpNG is stating that D&T will be the auditor of record after the 08, 09 filings. It is patently ridiculous for you to state that D&T will not begin their audit for first quarter 2010 which is due Oct. 15 until after the K is filed.
D&T are financial consultants as well as auditors and they could very well be wearing that hat in their involvement with the SEC investigation.
And No Bs said he had talked with employess of Big Four firms....D&T is number two in that group.
