NEW YORK (AP) -- If a reported deal between Ticketmaster Entertainment Inc. and Live Nation Inc. comes to pass, the combination will likely face regulatory hurdles, but if successful the combination would relieve competitive issues for both companies.
The Wall Street Journal reported Tuesday that an a merger between West Hollywood, Calif.-based Ticketmaster, the world's biggest ticketing company, and Beverly Hills, Calif.-based Live Nation, a concert promoter and artist-management company may be imminent. A deal would mark a strategic truce between companies that have begun intruding into each other's spheres in the entertainment industry.
Ticketmaster shares rose 98 cents, or 16 percent to $7.12 and Live Nation shares rose 66 cents, or 13 percent to $5.65 in morning trading.
"Such a deal would cap a year long process of increased competitiveness between the two companies," Thomas Weisel Partners analyst Benjamin Mogil wrote in a note to clients. The combination would allow Ticketmaster to avoid the competitive threat posed by Live Nation. Live Nation would gain access to more ticket sales.
The Journal, citing people familiar with the matter, said that neither companies' boards have signed off on a deal and it was not clear which company would be taken over. Mogil said Live Nation is the likely buyer based on market capitalization and momentum.
A combination would draw scrutiny from antitrust regulators because of the companies' influence in the music industry, but Mogil said regulatory hurdles are likely to be "manageable" given Ticketmaster already had Live Nation's ticketing rights up to Dec. 31. A deal would simply restore the status quo, he said.
With pacts struck in the fall, the companies moved into direct competition. Live Nation, the world's largest concert promoter, cut a deal in September to sell tickets at North American venues controlled by SMG, the venue management company. Ticketmaster, meanwhile, had accumulated a majority stake in Front Line Management Group Inc., a talent agency, by October.
Live Nation could benefit from a deal by gaining access to ticket sales at venues it doesn't operate or lease, a move the company hasn't been able to make Mogil said.
But for Ticketmaster, a merger may be more of a concession to rising competition. The company's "market position has been eroded considerably between the loss of the Live Nation contract" and sales at some SMG venues, Mogil said.
He added that without a deal Ticketmaster faces "the potential for more contract losses as Live Nation became increasingly aggressive in its pricing."
Ticketmaster stands to lose $140 million in revenue in 2009 and an additional $70 million in 2010 after Live Nation began selling tickets itself using technology and services from German ticketing company CTS Eventim, according to Mark Mahaney, an analyst at Citi Investment Research.

Shipping Stocks Pull Up Anchor

A day after DryShips' stock saw a notable lift, its rival Eagle Bulk Shipping's turn to shine.
Eagle Bulk shares were up nearly 30% to $7.11 in midday trading Wednesday, a few hours after the shipping industry got hearty nod from the talking heads on CNBC. A day before, all of the major shipping firms were in the green, and the Baltic Dry Index has risen the most since at least 1985, according to Bloomberg.
The Baltic Dry Index was rising 168 points, or 15%, to 1,316 points. After falling to 663 in early December, it has risen 70% in 2009. It's record high is 11,793 points on May 20.

Slipping below the radar (or under the short-term memory cap), the Democrats have already leaked a gun-ban list, even under the Bush administration when they knew full well it had no chance of passage (HR 1022, 110th Congress). It serves as a framework for the new list the Brady’s plan to introduce shortly.
I have an outline of the Brady’s current plans and targets of opportunity, It’s horrific. They’re going after the courts, regulatory agencies, firearms dealers and statutes in an all out effort to restrict we the people. They’ve
made little mention of criminals.
Now more than ever, attention to the entire Bill of Rights is critical. Gun bans will impact our freedoms under search and seizure, due process, confiscated property, states’ rights, free speech, right to assemble and more, in addition to the Second Amendment.
The Democrats current gun-ban-list proposal (final list will be worse):
Rifles (or copies or duplicates):

A semiautomatic pistol that has the ability to accept a detachable magazine, and has (i) a second pistol grip, (ii) a threaded barrel, (iii) a barrel shroud or (iv) can accept a detachable magazine outside of the pistol grip, and (v) a semiautomatic pistol with a fixed magazine that can accept more than 10 rounds.
A semiautomatic shotgun with (i) a folding or telescoping stock, (ii) a pistol grip (see definition below), (iii) the ability to accept a detachable magazine or a fixed magazine capacity of more than 5 rounds, and (iv) a shotgun with a revolving cylinder.
Frames or receivers for the above are included, along with conversion kits.
Attorney General gets carte blanche to ban guns at will:
Under the proposal, the U.S. Attorney General can add any “semiautomatic rifle or shotgun originally designed for military or law enforcement use, or a firearm based on the design of such a firearm, that is not particularly suitable for sporting purposes, as determined by the Attorney General.” Note that Obama’s pick for this office (Eric Holder, confirmation hearing set for Jan. 15) wrote a brief in the Heller case supporting the position that you have no right to have a working firearm in your own home.
In making this determination, the bill says, “there shall be a rebuttable presumption that a firearm procured for use by the United States military or any federal law enforcement agency is not particularly suitable for sporting purposes, and a firearm shall not be determined to be particularly suitable for sporting purposes solely because the firearm is suitable for use in a sporting event.”
In plain English this means that ANY firearm ever obtained by federal officers or the military is not suitable for the public.
The last part is particularly clever, stating that a firearm doesn’t have a sporting purpose just because it can be used for sporting purpose — is that devious or what? And of course, “sporting purpose” is a rights infringement with no constitutional or historical support whatsoever, invented by domestic enemies of the right to keep and bear arms to further their cause of disarming the innocent.

Word is (and word fits with what's happening), that the NRA has unofficially informed Senators that confirmation of extremely anti-gun Eric Holder as attorney general will not be held against them. That's why there has been almost no resistance and Holder sailed through committee with only two "No"s. In fact, more "A rated" Senators voted for Holder in committee than F-rated Senators, once again revealing the perennial fraud of NRA's black box system of unearned "A" grades for gun grabbers and squishes, top-secret candidate questionnaires, and endorsements of anti-gun candidates over viable pro-gun opponents. Had all the "pro-gun" senators in committee stuck together and opposed Holder, he would've lost the vote and the momentum and it would've been a new ball game. They didn't because it was not requested.

There is little resistance mainly because the NRA did not demand resistance and let it be known to the senate and their own members that blocking Holder is important. "Pro-gun" senators still have the numbers to block him by filibuster -- if they actually tried, if senators knew that voting for cloture would be punished in grading and support. The enemy must bring 60 hard votes to kill a filibuster, even if only one senator shows up to support it. But the NRA will let Holder go to the floor, where he will be confirmed by majority.

I suppose blocking Holder is not as important as blocking an assault weapon bill. Perhaps that explains why GOA's alert yesterday doesn't mention the word filibuster http://gunowners.org/a012909.htm , though it says "if confirmed, [Holder] will be in a position where he will be able to use the force of government to discourage or outlaw gun ownership in America." If Holder is really that dangerous, isn't it worth pushing for filibuster, where he could be stopped with a minority? I don't know.

If NRA members don't force the NRA to start holding Republicans accountable with honest grading and smart grade-weighting, then we are much more likely to get another AW ban and other new controls. Even though "pro-gun" senators have the power to block and filibuster it, enough of the phonies will flip to kill the filibuster, then the pro-gun side will cast a phony prearranged losing vote against the bill on the floor. They will let it pass while appearing to oppose it, and use the new law to force gun owners to increase donations and support. The NRA will help them do it by covering it up with dishonest grades and endorsements. It's like a protection racket.

FORD SELECTS BATTERY SUPPLIER FOR PLUG_N HYBRID
WASHINGTON (Reuters) - A partnership between Johnson Controls Inc and France's Saft will supply a complete battery system for Ford Motor Co's first plug-in hybrid, due out in 2012, Ford said Tuesday.
Ford also said ahead of the Washington Auto Show that seven utilities, including Consolidated Edison Inc, American Electric Power Co and Michigan's DTE Energy Co, will join its ongoing research effort to test rechargeable plug-ins and assess their impact on the electrical grid.
Ford has not identified a vehicle to market but is testing a fleet of Escape hybrid sport utilities with its research partners.
"We are at the point where we need to work with the battery supply base, the utility industry and the government in order to find ways to make electrified vehicles an affordable proposition for consumers," said Sue Cischke, Ford group vice president for environment and safety.
"Plug-in hybrids hold great promise but do still face significant obstacles to commercialization," Cischke said.
The development adds new momentum in the race among major auto companies to develop mass-market batteries and roll out a commercially viable plug-in.
Ford selected Washington for its announcement with the most senior transportation, energy and environmental officials from the freshly minted Obama administration scheduled to attend the auto show on Tuesday.
President Barack Obama has expressed strong support for advancing hybrid technology and alternative fuels as means to reduce gasoline consumption, cut tailpipe emissions, and lift Ford and the other U.S. auto manufacturers and suppliers out of their worsening financial tailspins.
Automakers are lobbying Congress to include battery funding initiatives and plug-in tax breaks in U.S. economic stimulus legislation now before the Senate.
Plug-in designs envision vehicles running on electricity alone for short distances and recharging via a household electrical outlet.
Johnson Controls Saft will develop a lithium-ion battery for Ford's plug-in vehicle. The five-year supply agreement includes a target of 5,000 units per year.
Johnson Control Saft recently signed a contract to provide batteries for BMW AG's 7 series hybrid car.
General Motors Corp last month announced that South Korea's LG Chem Ltd would supply battery systems for the Chevrolet Volt plug-in, due out in 2010.
Chrysler LLC, which along with GM received a government bailout in December, has shown off three electric car prototypes and said it intends to sell one by next year as well. But analysts say Chrysler trails rivals in this area.
Japan's Toyota Motor Corp plans to market a test fleet of rechargeable hybrids to companies or government agencies by the end of next year.
Toyota, a global sales giant with its leading Prius hybrid, is also preparing to build a factory to produce the next generation lithium ion batteries for plug-ins and electric-only vehicles.
