Federal Judge Sides With Trump, Allows More Time to File Motions

The federal judge overseeing the Trump classified documents case handed defense lawyers a win on Monday, allowing a 10-day extension to file motions.
In a paperless order on Monday, U.S. District Judge Aileen Cannon granted former President Donald Trump a 10-day extension, meaning that he shall file a reply to their pretrial motions by March 24. His lawyers had made the request this week, arguing that they are preparing for a separate criminal trial in New York over state charges that he allegedly falsified business records at the end of the 2016 election.
The former president’s attorneys wrote that both President Trump and his attorneys “are currently preparing for a trial in New York, New York that is scheduled to begin on March 25, 2024, and the need to simultaneously devote attention to that case.
“This matter has been necessitated in part by the discovery violations and strategic scheduling demands of the Special Counsel’s Office that have prejudiced President Trump in multiple respects,” they added.
The lawyers also asked Judge Cannon to grant them more time to prepare for a hearing in the documents case in order to file materials to support multiple previous trial objections. And, according to the lawyers, President Trump needs to travel to Fort Pierce, Florida, for a hearing in the case and needs more time to prepare.
But Jay Bratt, a Department of Justice (DOJ) official who handles certain counterintelligence matters and works under Mr. Smith, filed an objection to the lawyers’ request hours later, saying that “the fact that the defense must travel to Florida for a hearing on Thursday is not unique to those teams and poses no cause for such delay.”
And Mr. Bratt added that the filing from President Trump’s attorneys on Monday is a last-minute attempt to delay the case.
“The briefing schedule has been in place for months. Only now, on the eve of the reply deadline, does the defense complain that it needs more time—mostly based on circumstances about which they have been aware throughout the pendency of their motions,” the DOJ official wrote Monday.
Trial Date
During a recent court hearing in Florida, federal prosecutors asked Judge Cannon to schedule the Trump documents trial for July, while the former president’s lawyers argued that it should be held off until after the November election. The judge didn’t set a date but appeared to shoot down the July suggestion.
The case had been scheduled to reach trial on May 20, but Judge Cannon signaled months ago that she intended to reconsider that date.
President Trump is facing 40 federal charges for alleged mishandling of sensitive and classified materials that were obtained from his Mar-a-Lago resort in Florida after he left the White House in 2021. Officials have also accused him for obstructing attempts to get them returned to the federal government.
The former president has pleaded not guilty to the charges, saying the charges are an attempt to to interfere in the 2024 election while he is the leading Republican presidential candidate. He also faces charges in New York City, Washington, and Georgia and has pleaded not guilty in those cases.
On March 25, he is scheduled to go to trial over claims that he falsified business records to provide adult film actress Stormy Daniels with “hush money” payments. Prosecutors in New York City allege that his campaign falsified business records to cover up the payments, which President Trump has denied. He also denied having an alleged affair with Ms. Daniels, whose real name is Stephanie Clifford.
Judge Allows Amicus Briefs
Last week, Judge Cannon issued a paperless order to allow two amicus briefs, known as “friend of the court” briefs, to be filed to support President Trump’s case. One was written by a former U.S. attorney general, Edwin Meese, and the other was submitted by a group headed by former Trump adviser Stephen Miller.
“The Court has reviewed the motions and finds that the proposed amici bring to the Court’s attention relevant matter that may be of considerable help to the Court in resolving the cited pretrial motions,” Judge Cannon wrote in her order, referring to the two motions. “The amicus briefs are accepted for Court consideration.”
Mr. Meese’s brief argued that current Attorney General Merrick Garland improperly appointed Mr. Smith to be special counsel in the two cases, arguing that only Congress can appoint such officials.
Those arguments have been rejected by the special counsel in a separate Trump case, while Mr. Garland in 2023 said that he had the constitutional authority to do so.
“Neither Smith nor the position of Special Counsel under which he purportedly acts meets those criteria. He wields tremendous power, answerable to no one,” Mr. Meese and two law professors wrote. “And that is a serious problem for the rule of law—whatever one may think of former President Trump or the conduct Smith challenges in the underlying case.”

Right-wing conspiracy theorist Alex Jones has accused Donald Trump of spreading "bull s***" after the former president said he got coronavirus vaccines approved for the public in just nine months.
Jones, who has spoken out repeatedly in support of Trump, falsely labeled COVID-19 vaccines "a biological weapon" in a post on X, formerly Twitter.
Trump was responding to remarks that President Biden made on Thursday at his State of the Union address, when he said: "The pandemic no longer controls our lives. The vaccines that saved us from COVID are now being used to help heat cancer, turning setback into comeback."
Responding on his Truth Social website, Trump look credit for the vaccines' rapid approval, commenting: "YOU'RE WELCOME, JOE, NINE MONTH APPROVAL TIME VS. 12 YEARS THAT IT WOULD HAVE TAKEN YOU!"
Trump's post sparked an angry response from a number of commentators who have promoted discredited conspiracy theories about the coronavirus vaccines.
Conservative podcaster Tracy Beanz screenshotted Trump's Truth Social post, adding: "The amount of anger I have over this can't be quantified in words."
This was reposted in turn by Jones, who commented on X: "I love Trump but this is bull s***! The so called vaccine is a biological weapon! Good news is people are awake and not even 45 [Trump was the 45th president] can sell it."
Other X accounts agreed with Jones, as one self-styled 'America First' campaigner wrote: "This is how Trump will lose voters. Whoever is advising Trump should tell him to distance himself from praising 'vaccines' that have killed hundreds of thousands people."
Marie Isabella, an X user with 11,700 followers, posted: "I can't believe he is continuing to double down on the vaccine. It's also unbelievable that they continue to call it a 'vaccine,' and that they're still pushing boosters, despite more studies indicating serious problems with the vax."
Referring to Trump, a third user commented: "I think he doesn't still understand how completely Fauci and his acolytes took advantage of him regarding the vaccine. Trump was fooled into thinking he was doing something great. His ego won't let him see how wrong he was."
There is no evidence to support the claim that COVID-19 vaccines have "killed hundreds of thousands of people," whereas the virus itself has killed more than 1.1 million Americans, according to the federal Centers for Disease Control and Prevention (CDC).
On its website, the CDC describes the vaccines as "safe and effective," adding that "during the COVID-19 pandemic, hundreds of millions of people in the United States received COVID-19 vaccines under the most intense safety monitoring in U.S. history."
In May 2020, the Trump administration announced the launch of Operation Warp Speed, with the aim of accelerating the development of vaccines for COVID-19.
The federal Food and Drug Administration approved the first COVID-19 vaccine for use in the U.S., which was produced by Pfizer, in August 2021.
In December 2021, Trump was booed by part of a crowd that had come to see him in Houston, Texas, after saying he had received a COVID-19 vaccine booster shot, as well as the original jab.
Speaking at a rally in Rock Hill, South Carolina, last month, Trump said: "I will not give one penny to any school that has a vaccine mandate or a mask mandate." Karoline Leavitt, a Trump campaign spokesperson, later told Newsweek the former president was "talking about COVID vaccines in addition to masks in the same breath."
Trump’s vaccine rhetoric sends chills through public health circles

Public health advocates are watching in growing alarm as former President Trump increasingly embraces the anti-vaccine movement.
“I will not give one penny to any school that has a vaccine mandate or a mask mandate,” Trump said in a recent campaign rally in Richmond, Va.
It’s a line Trump has repeated, and his campaign said he is only referring to school COVID-19 vaccine mandates — but that hasn’t eased fears that the GOP leader could accelerate already worrying trends of declining child vaccination.
Trump “is an important voice. He has a big platform. And he uses that platform, in this case, to do harm. Because he’s implying by saying that we shouldn’t mandate vaccines, vaccines are in some ways ineffective or unsafe,” said Paul Offit, a pediatrician and vaccine expert at the Children’s Hospital of Philadelphia.
The ironic part, Offit noted, is that the Trump administration kickstarted Operation Warp Speed, which helped drug companies use a relatively new technology to make two very effective and safe COVID-19 vaccines in less than a year.
Throughout the campaign, Trump has performed a complicated tap dance regarding COVID vaccines. He simultaneously wants to take credit for their speedy development but has also criticized their use and knocked his now former rivals for being too pro-vaccine.
In a post on Truth Social reacting to Biden’s State of the Union speech on Thursday, Trump again claimed credit for the COVID-19 shots.
“You’re welcome, Joe, nine month approval time vs. 12 years that it would have taken you!”
Every state and the District of Columbia requires children to get vaccinated against certain diseases before they start school, including measles, mumps, polio, tetanus, whooping cough and chickenpox. A plan to withhold federal funding would have widespread impact.
“Like most states, Virginia requires MMR vaccine, chickenpox vaccine, polio, etc. So Trump would take millions in federal funds away from all Virginia public schools,” former GOP Rep. Barbara Comstock (Va.) wrote in response to his campaign threat on X, formerly Twitter.
Since the public health emergency ended last May, no state requires students to get the COVID-19 vaccine, while 21 states have laws specifically banning schools from requiring COVID-19 shots.
Trump’s campaign says his comments only apply to states that mandate COVID-19 vaccines — making it essentially an empty threat.
“If you actually listen to the entire section, and also if you’ve been following his speeches for the past year, he’s talking about COVID vaccines in addition to masks in the same breath. This isn’t anything new,” Trump campaign spokesman Steven Cheung said in an email.
Experts say the politicization of vaccines has led to an increase in hesitancy and is sparking more outbreaks of preventable diseases like measles.
There have been measles outbreaks in 15 states this year, most recently in Florida, where state Surgeon General Joseph Ladapo did not recommend parents vaccinate their children or keep unvaccinated students home from school as a precaution.
Instead, he sent a letter to parents advising them to make their own decisions about school attendance.
Ladapo was appointed by Gov. Ron DeSantis (R) in 2021 and has since aligned himself with anti-vaccine sentiments, primarily about the COVID-19 shots.
Ladapo told people not to get the most recent shot and has drawn sharp rebukes from the medical community — as well as federal health agencies — for claims that the shots alter human DNA, can potentially cause cancer, and are generally unsafe.
Georges Benjamin, executive director of the American Public Health Association, said he worries that Trump is signaling he will empower more people like Ladapo if he wins reelection.
“I worry about any administration that doesn’t follow good evidence and good science, that they will put more and more people like them in their administration,” Benjamin said.
“We know that Trump had some extraordinarily competent people [in his first term]. But we also know that he had some extraordinarily incompetent people, and that in many situations, some of the really incompetent people carried the day because they aligned with his philosophy,” Benjamin added.
Robert Blendon, a professor emeritus of health politics at the Harvard School of Public Health, said the experience in Florida and the comments from Trump are part of a much broader Republican backlash against public health expertise and government mandates that can be traced to anti-COVID policies.
“It isn’t that he’s just going after these anti-vaccine votes,” Blendon said of Trump.
Trust in public health authorities has dropped precipitously among Republicans since 2021, and Blendon said Trump is a symbol of that. The anti-vaccine movement has never been associated with one particular political party, whereas the public health backlash is strongly Republican-centric.
“That’s made it very, very powerful,” Blendon said. “There are Republicans in the House and Senate, who when they’re not investigating public health, want to cut back the budget … so it has caught on within the Republican base very widely.”
Whether it’s anti-vaccine specifically or anti-public health more broadly, the sentiment is growing.
According to the Centers for Disease Control and Prevention, the percentage of kindergartners whose parents opted them out of school-required vaccinations rose to the highest level yet during the 2022-2023 school year.
Robert F. Kennedy Jr., a well-known vaccine skeptic who is running for president as an independent, has gained a major platform to spread misinformation and widely debunked claims about vaccines.
He has falsely claimed vaccines cause autism, falsely declared the coronavirus shot is the world’s deadliest vaccine and questioned the safety of shots’ ingredients.
Offit, the vaccine expert, said he thinks public health officials could have done a better messaging job on the COVID-19 shots, and that by mandating vaccines they “inadvertently leaned into a Libertarian left hook.”
Still, Offit said he is concerned about the increasing anti-science rhetoric from politicians like Trump.
“I feel like we’re on the edge of a precipice here … you have the most contagious of the vaccine preventable diseases coming back to some extent, and with Donald Trump basically casting aspersions on vaccines, that’s only going to worsen.”

There is great financial news for Donald Trump.
Delaware Chancery Court Judge Sam Glasscock III has declined to block the March 22 shareholder vote on a merger involving Trump Media & Technology Group, which might result in a $4 billion gain for President Trump.
This court decision came despite protests from Trump Media co-founders Andy Litinsky and Wes Moss, who claim that the merger will reduce Trump’s 8.6% ownership in the firm. Litinsky and Moss were previous competitors on Trump’s TV show The Apprentice, and they eventually collaborated with him to build Trump Media.
Glasscock declined to schedule a hearing on the challenged merger before the March 22 vote. He stated on a Zoom call that if Trump agrees to place the extra shares in an escrow account during the dispute, “maybe the whole thing will go away.”
Officials at Digital World Acquisition Corp., the blank-check corporation that will handle the vote, have already agreed to put the disputed stock in escrow in response to a separate complaint brought by Patrick Orlando’s ARC Global Investments II, Bloomberg reported.
ARC opposed the suggested conversion rate for its founder’s interest, arguing for a larger share in the merged entity. Orlando, Digital World’s former CEO, filed the case.
Lori Will, the Chancery judge hearing the case, recently refused a plea to accelerate the proceedings, citing the escrow agreement.
CNN earlier reported on the potential windfall for Donald Trump from the media merger.
The business development comes in the aftermath of an unprecedented New York civil case that hammered the former president with $350 million in damages.
Judge Arthur Engoron ruled in February that Donald Trump must pay the massive sum and barred Trump “from serving as an officer or director of any New York corporation or other legal entity in New York for a period of three years.”
Trump enterprise Truth Social faces considerable obstacles, but it has a promising future if it “goes public.” The platform was once valued at over $700 million in 2022 and has since dropped in value to less than $100 million.
If that happens, Trump’s stake in Truth Social may increase to an impressive $4 billion.

More than a dozen state attorneys general (AGs) are accusing banking titan Wells Fargo of abruptly terminating customers’ accounts without warning.
In a letter addressed to Wells Fargo CEO Charles Scharf, 16 Republican AGs across the country accuse the trillion-dollar lender of debanking customers in a political and discriminatory manner.
The AGs say Wells Fargo has started a new trend that looks at clients’ political views as a basis for retaining banking access.
“Within this context, Wells Fargo’s decisions to debank Republican candidates and gun industry participants reveal a new troubling trend…
Blanket prohibitions and policies against providing service to certain customers lead to the inevitable question – who is next? Which types of companies or people will Wells Fargo determine cannot be allowed as customers? Is this why Wells Fargo apparently closed the accounts of former Republican candidates Lauren Witzke and Pete D’Abrosca on the same day in 2021?”
The AGs say the alleged pattern may be in violation of state laws.
“Wells Fargo should cease its efforts to discriminate based on ESG (environmental, social and corporate governance) objectives, and publicly commit to serving Americans in a fair, nondiscriminatory, and lawful manner. States possess meaningful authority over banks under civil rights and unfair and deceptive acts and practices (UDAP) statutes.”
The 16 AGs end the letter asking Wells Fargo to stop its debanking policies and respond to its concerns by April 4th.
The AGs who signed the letter include Austin Knudsen of Montana, Tim Griffin of Arkansas, Raul Labrador of Idaho, Todd Rokita of Indiana, Kris Kobach of Kansas, Luz Murrill of Louisiana, Lynn Fitch of Mississippi, Andrew Bailey of Missouri, Mike Hilgers of Nebraska, John Formella of New Hampshire, Dave Yost of Ohio, Alan Wilson of South Carolina, Jason Miyares of Virginia, Patrick Morrisey of West Virginia, Sean Reyes of Utah and Bridget Hill of Wyoming.
And they said they wouldn't, no surprise.
South Carolina Becomes 29th State to Allow Carrying Firearms Without a License

South Carolina is now the 29th state to legalize carrying a firearm without a permit, so-called “constitutional carry.”
On Thursday, March 7, 2024, Gov. Henry McMaster signed H 3594 into law.
The new law eliminates the requirement for a concealed weapons permit, sets the minimum age to receive a license to 18, and sets a comprehensive list of “sensitive areas” in which guns are prohibited.
The list includes schools, government buildings, health care facilities, places of worship, law enforcement centers, and any place prohibited by federal law.
It leaves the current permitting process in place for those who wish to get a permit to carry in states that recognize South Carolina’s license. South Carolina’s concealed carry permit law requires eight hours of training. The new law does away with that requirement but strongly encourages citizens to get firearms training.
The new law also sets steeper penalties for those convicted of carrying a gun in a sensitive area without a permit as an incentive to get licensed.
Gov. Henry McMaster released a statement celebrating the new law.
“This bill expands the Second Amendment rights of our law-abiding citizens and will keep violent criminals behind bars with increased penalties for illegal gun use and possession,” Mr. McMasters’ statement reads.
Supporters of the measure say the proposed law enables South Carolinians to finally exercise their Second Amendment right.
Gun rights advocates hailed the new law as another step toward fully restoring Americans’ Constitutional rights.
“We’re excited that South Carolina Finally did the right thing. We’re grateful to see the expansion of Second Amendment rights,” Chris Stone, state and local affairs director for Gun Owners of America, told The Epoch Times.
The National Rifle Association also weighed in on the development.
“The NRA celebrates another significant milestone as South Carolina becomes the 29th state to enact the landmark NRA-backed Constitutional Carry legislation. This pivotal move ensures South Carolinians are no longer required to obtain permission to defend themselves and their families, reinforcing the fundamental right to self-defense,” Randy Kozuch, the executive director of the NRA Institute for Legislative Action, wrote in an email to The Epoch Times.
Everytown for Gun Safety, which the South Carolina Chapter of Moms Demand Action is affiliated with, did not respond to an email seeking comment. The group has opposed this and similar legislation in the past.
Dan Roberts, outreach director and media liaison for South Carolina Carry, said he has been working with other South Carolinians to institute Constitutional Carry in the state for 10 years.
“It’s been quite a slog,” he told The Epoch Times.
Mr. Roberts said that he is pleased with the bill overall, though there are some parts he would change if he could. He said he doesn’t see why a person who carries a gun into a sensitive area without a license should face a stiffer penalty than someone who has a permit.
And, while the law does away with the training requirement, the permitting process still mandates eight hours of training. Mr. Roberts said that both provisions should be changed to provide incentives for training. He said it would be more effective to offer tax breaks for the purchase of gun safes or allow carry in certain sensitive areas for those who receive training.
“If you incentivize it, that’s the way you motivate people to get the training,” Mr. Roberts said.
Focus On the Good
Still, he said that in his political career, he has learned one valuable lesson.
“Never let the perfect be the enemy of the good,” he said.
South Carolina State Sen. Rex Rice was an early proponent of the legislation. He also favors the training element of the law. He strongly encourages even those who choose not to get a license to get some training if they are going to carry a gun.
“You need to be proficient with the weapon you’re carrying, and you need to know what the law says,” Mr. Rice said.
Mr. Rice said that many of his constituents supported Constitutional Carry because they don’t trust the government. He said they are concerned their personal information would be used to compile a registry of gun owners.
“People don’t want to give the government their information,” he told The Epoch Times.
Mr. Roberts said the new law is more than just an expansion of gun rights. He pointed out that a majority of states have expanded gun rights. In an election year, it would do federal incumbents well to pay attention to the message he believes is being sent by state legislatures: Gun control as crime prevention is not working.
“People are tired of being demonized, villainized, and scapegoated for the criminal acts of people that they had nothing to do with,” Mr. Roberts said.
