The House sponsor of a marijuana banking bill says he recently spoke with Senate Majority Leader Chuck Schumer (D-NY) at an event at the White House and discussed the need to enact the bipartisan reform this session.
Rep. Ed Perlmutter (D-CO) said that he impressed upon the leader the importance of his Secure and Fair Enforcement (SAFE) Banking Act, which has cleared the House in some form seven times only to be held up in the Senate under Republican and Democratic control. Schumer, the congressman said, assured him that the chamber is “working on it” and is “going to get going” on the reform.
“Whether that was just lip service or reality, there is momentum,” Perlmutter, who is retiring at the end of this Congress, told KOA radio. “We’re going to get this done. It probably won’t happen until the lame duck session after the elections, but I’ve always felt confident that commonsense will prevail and we’ll get this finished, and I think we will.”
“If we allow legal [marijuana] businesses to have legal banking services, it only makes sense and it helps us in a public safety way so people don’t get killed—so that somebody in a dispensary isn’t held up and shot,” the congressman said.

The Senate Judiciary Subcommittee on Crime and Terrorism, chaired by Sen. Cory Booker (D-NJ), will meet on July 26 for a meeting titled “Decriminalizing Cannabis at the Federal Level: Necessary Steps to Address Past Harms.”
While details are limited, it’s reasonable to assume that senators on the panel will be discussing long-awaited legislation from Booker, Senate Majority Leader Chuck Schumer (D-NY) and Senate Finance Committee Chairman Ron Wyden (D-OR), which Senate sources recently told Marijuana Moment could be filed as early as this week.
That bill—the Cannabis Administration & Opportunity Act (CAOA)—was released in draft form a little over a year ago. Advocates and stakeholders have been eagerly awaiting its introduction, and the timeline for the filing has been repeatedly pushed back as the sponsors have worked across the aisle to solicit feedback and build buy-in, but Schumer has made a “promise” that it would drop before the August recess.
Now with a key subcommittee headed by a sponsor scheduling a meeting on the specific issue it addresses, it seems that CAOA’s introduction is likely less than a week away. Marijuana Moment reached out to Schumer’s and Booker’s offices for comment, but representatives were not immediately available.

Democrats are looking for a weed deal
As this Congress enters its final months, lawmakers warm to the idea of cannabis banking “plus.”
Senate lawmakers previously opposed to anything but a major marijuana decriminalization bill are slowly warming to another option: adding provisions to a broadly supported bill that would allow financial institutions to offer banking services to the cannabis industry.
Senate Majority Leader Chuck Schumer doesn’t have the votes to pass a sweeping marijuana decriminalization bill — despite repeatedly touting his support for ending federal prohibition.
That realization is leading Senate Democrats to look for a compromise on weed.
In interviews with more than a dozen lawmakers, staffers, advocates and lobbyists, all agreed that in recent weeks the tone has changed on Capitol Hill. Senators previously opposed to anything but a major marijuana decriminalization bill are slowly warming to another option: adding provisions to a broadly supported bill that would allow financial institutions to offer banking services to the cannabis industry, called the SAFE Banking Act.
The change in approach is driven in part by the fact that the clock is ticking on Democratic control of Congress — experts say the House will likely flip in November, and the Senate could join it. Despite the often-bipartisan nature of cannabis legislation, it does not enjoy strong support from GOP leadership in either chamber. So lawmakers involved in weed policy are looking more seriously at what they can accomplish in the last six months of this Congress.
“There’s a greater sense of urgency,” said Rep. Earl Blumenauer (D-Ore.), who has been trying to shepherd cannabis legislation through Congress for decades. “I think there’s a broader base of support.”
Tentative negotiations
Every lawmaker and staffer who spoke with POLITICO for this story said that there is, as of yet, no tangible legislative plan. Most described the conversations as merely testing the waters on what might be possible later on in the year.
Discussions have happened or are scheduled between Schumer and weed-friendly Republicans such as Sen. Lisa Murkowski (R-Alaska) and Rep. Dave Joyce (R-Ohio). But Joyce told POLITICO earlier this month that his conversation with Schumer did not include any formal strategy or legislative plans. Right now, most of these talks are among Senate Democrats, who eventually want to agree on something they can propose to Republicans.
Some hope that a deal on cannabis — an issue that enjoys support from both sides of the aisle — could also ride the Senate’s current bipartisan wave. Democrats and Republicans in the upper chamber have recently reached agreements on thorny issues like gun control and insulin pricing.
“The discussion is about using SAFE as the nucleus of the thing, and [to] add some provisions that will be acceptable to Democrats and Republicans in the Senate,” said Rep. Ed Perlmutter (D-Colo.), the cosponsor of the bill in the House. “It’s at its very early stages.”

The introduction of a long-awaited Senate bill to federally legalize marijuana is imminent, with two Senate sources telling Marijuana Moment on Thursday that the legislation could be filed “as early as next week.”
It’s been a year since Senate Majority Leader Chuck Schumer (D-NY), Senate Finance Committee Chairman Ron Wyden (D-OR) and Sen. Cory Booker (D-NJ) first released a draft version of comprehensive legislation to end federal cannabis prohibition and promote social equity in the industry. And on Thursday, Bloomberg reported that the bill’s introduction would be coming next week.
But sources on Capitol Hill who are familiar with the planning tell Marijuana Moment that the exact timing is still in flux. It’s possible that the Cannabis Administration & Opportunity Act (CAOA) could drop next week, they say, but there are no scheduled plans to do so at this point, despite what Bloomberg reported. However, they maintain that the bill will be introduced ahead of the August recess just weeks away, as Schumer has promised.
The timeline for the introduction of CAOA has been repeatedly pushed back as leadership has worked to gather input on various provisions and build bipartisan buy-in. The majority leader had said earlier this year that CAOA would be filed in April, but that did not pan out. He then amended the timeline and made a “promise” to bring the bill forward ahead of the recess.
Details about any changes to the bill since it was released last year are still being heavily guarded. But it’s expected to contain the key components: removing cannabis from the Controlled Substances Act, imposing a federal tax on marijuana sales, promoting equity in the industry and providing an avenue for relief for those who have faced federal cannabis convictions.
Once the measure is introduced, its path to passage is still murky. There’s a fair level of skepticism about the prospects of reaching the 60-vote threshold needed to pass CAOA through the Senate.
Republican senators are generally expected to oppose a measure that would deschedule cannabis, especially if it involves imposing a federal tax and using revenue to meet equity objectives. At the same time, it’s far from certain that all Democratic members of the Senate will back the legislation, as several members have been either non-committal or indicated that they’d oppose it based on the original draft language. Democrats hold a slim majority in the chamber, so any dissent within the caucus could jeopardize the bill’s chances of passage.
But Schumer says he isn’t deterred by those political obstacles, or at least is unwilling to break his promise to bring the bill to the floor for a vote. A year of coalition building—in concert with bipartisan offices, advocacy groups and stakeholders—is moving the legislation in the right direction, he’s signaled.
