Mystery Man.... Well, it's just my opinion, but I think that this surge is the result of some who sold at a loss last December and are just now past the 30 day wash rule for the IRS. There was a surge in volume the last days of the year as the price dropped, probably caused by those sales.
It's now 30 days +- and those buyers are getting back in.
I did it myself to offset some other gains that I had. It saved me about $1500 in taxes. If I am right, ( often I am not ) this is just another temp spike. I don't expect any substantial gains until we get some news on production and revenue.
But....I'll take it any way I can get it. I'm going to slip back into the darkness now. Would someone wake me when we get news??? lol

hinch, I have said before that I believe that article was very important. It shows the high demand for the product and proves that people there are willing and ABLE to pay for the drug - even at a premium.
Production is all that is lacking in this formula.

I know this will make some of you guys mad... but I've got to repeat what I've said before:
All this BS about lawsuits and complaints with the SEC are a waste of time and may cause more harm. At the current price, this whole company is only valued at about $12million??? ( 1.7b x .007 )
The SEC couldn't care less about a pink sheet company who's only crime is not trying to pump it's stock with press releases.
The current BOD & friends are professionals who do have legal advice. They are not doing anything that will get them in trouble. Either they will turn this around in time and we all make money, or they screw us and only they make money. Either way, there is no way they'll get caught doing anything that leaves them liable.
Keep yelling "I'm gonna get a lawyer..." and they may decide that there's no need to play nice with us.

Tex, there are a couple of us here, but in reality, there is little that stockholders can do unless they control a majority of stock.
The board can do pretty much whatever it wants - short of taking cash straight out of the cash drawer. They can vote themselves and the mangement bonuses and stock options out the wazooo - nothing we can do about it.
The only choice you have is to replace them with a majority vote and hope the newly elected ones treat you better.
If you look at the share stucture, you see that the majority of shares are controlled by a few persons / groups. For example: Pandy was guaranteed 20% of the voting power no matter how the share structure changes. He has been granted a special class of stock in the past to keep his voting rights.
Ironically, there is no way that the members here could get a majority without collaborating with Pandy, BASU, Marge or others. Doesn't that sound like fun?
Threatening them without having the votes to carry through would probably just make them mad and make it worse. Wait! Is that even possible?? lol

According to US tax law, payments that are illegal (like bribes) are not allowed as a deduction for tax purposes.
HOWEVER:
In true IRS fashion, just to confuse things: another section states that if you do business in a foreign country where bribes are Ordinary business practice and Necessary in order to do business, then you may deduct the cost as a business expense....

I'm not wealthy by any means, but I manage to keep my debt down ( credit cards are devices of the Devil - jajaja )and pay cash as much as possible so I'm not in bad shape even if this tanks completely. I've got some retirement money locked up where I can't invest it even if I wanted to. lol
I'd never invest money that I couldn't afford to lose in a company without an earnings & mangement record to look at. I hope that this bounces back and we all come out better off. If not, just remember: It's only money, not the stuff life is made of.

CTO, I have had similar thoughts. I am not too worried about dropping off of the BB listing. I think that the price has already been discounted in anticipation of that.
My biggest concerns are: our financing that was arranged through UPS Capita - Are we required to keep financials current ? idk
If so, what happens when we don't?
and: will BASU screw us out of the Nigerian Subsidiary with a sweetheart deal where they get the gold mine & we get ....
Anyway, I'm still waiting around to see how it'll turn out.

In answer to your question, Yes Pinks can turn multiple millions in a day. It's just like any other market.... How many buyers do you have and what are they willing to pay???
There are a lot of people who play the Pink Sheets - It's kind of like roulete / the Russian kind
There are some companies that stay on the Pink list deliberately for years - even after being profitable. If they are closely held, and controlled ( like XKEM is, or will be ) it doesn't make much difference. They save money on audits and filings, get to ignore their smaller stockholders and just do what they want. -

The agent is called 5-Hydroxymethyl-2-Furfural or 5HMF. Medicinal Chemist Donald Abraham, Ph.D., says the molecule occurs naturally as a breakdown product in plants and some foods. Researchers have found 5HMF appears to have anti-sickling properties in red blood cells. The drug works by increasing the supply of oxygen inside the red blood cells, reducing their ability to sickle. Studies in mice showed the animals that were treated with the agent had significantly longer survival rates compared to untreated sickle cell mice.
this could be the next performance enhancing "supplement" for Major League Baseball. If so, we could make a killing... lmao

mpd68, the accountant does have to sign the AUDIT report (if an audit is done). The accountant is never responsible for the contents of the financial statements, just performing his duties as an auditor.
The audit report always says that there is no way to guarantee that fraud has not been committed.
Ultimately, the officers of the corporation (President and CFO) are responsible for the accuracy of the financial statements - they sign these. It is possible that the old accounting firm discovered problems and that is why they no longer work for the co.
If an outside accountant discovers problems with the financial statements, he must inform the audit committee (Burg was on it) and the company must amend the reports. If it refuses to do so, the accounting firm must withdraw from the engagement and cannot continue to work for them.

The Nigerian government has acknowledged that pharmacies there are selling Nicosan at a huge mark-up because of the demand. Finishing that production plant and getting it on-line is more important than staying listed on the OTC.
Certainly it would be nice to do both, but I'd be happy with some large sales figures. Hopefully, we'll get some PR's soon with or without the Q.

rap, the 8K & 10Q are not directly related. Since the company was listed at the time that the material events took place, they were obligated by SEC regs to file the 8K and report the events within a set timeframe.
Failure to file the 8K could cause fines & restrictions placed on the company. - The officers can be held personally liable for the failure to report these changes.
As I understand it (I may be wrong , not filing the 10Q timely does NOT result in any fines. It does result in the stock not being listed on the OTC, but there's no penalty attributable to the officers for it being late or not filing.
I don't know what's going on, and would certainly like to see the Q filed, but I'm not holding my breath waiting for it.

drift, I understand that we are currently listed as a BB stock, however: Stocks can be offered for sale on both boards at the same time. If this is done, there are special rules that apply to being dropped from the upper level. I don't claim to know how they apply to us, but I found this:
Delisted from an Exchange
If a security is delisted from The New York Stock Exchange or from the American Stock Exchange, then the usual Form 211 filing and review process will apply. However,
some exchange-listed securities are already quoted in the Pink Sheets on an unpriced basis. This provides the market maker with an exemption to filing a Form 211 in the event the security is delisted from the Exchange.
In this case, any market maker that had been quoting the security in the Pink Sheets for the 30 days prior to delisting could continue to make a market in the Pink Sheets upon delisting. The security generally becomes "piggy-back qualified" the same day it is delisted and any other market maker can then enter its quotes in the Pink Sheets without first submitting a Form 211 to the NASD. To find out if an Exchange-listed security is being quoted on the Pink Sheets concurrently, please call Pink Sheets' Issuer Services Department at 212-896-4420 or email us at issuerservices@pinksheets.com.

SledDog, I'm not sure, but I think XKEM has always been dual-quoted on the otcbb & pink sheets. If you go to the pink sheets web site, you can pull up a quote for XKEME.
They may not need to re-apply it may still be quoted as a pinky even if the Q isn't filed.
Even if we go pink, it doesn't have to be the end of the world. If we get revenue numbers and see that sales are building, and some good news about production being pumped up, we will still see the stock price rise.
