Anyone who believes Megas is not directly responsible for BCIT not trading, needs to go outside and breathe in some fresh air for a change. By "not trading", I mean both the cessation, as well as the non-resumption. Do you think Megas sent that childish-tantrum letter to Burns "in the heat of the moment"? If a person suspects that they're going to have a difficult time proving their side, for whatever reason, that's usually exactly what they do - throw a tantrum and storm out. It's basic human psychology. The only thing genuine is Megas' transparency, after all these years. Don't sit and wait expecting Megas to pursue this.
If basic maths dictates that it would take n infinitessimal fraction of the cost of "fighting" to simply go and start several new shells, I really don't understand why anyone expects Megas to give an ant's piss about this broken shell.

Yes to your second, earthenperson. As far as getting a written guarantee from them, I think I'd rather just leave my order be for the time being. Who knows, come Monday, the order could be cancelled for all I know, but for now... if it ain't broke, why fix it? ;)

If I'm not mistaken, that post simply asked Art if he had proof that NSS existed in BCIT's case, in reply to Art's claim in a prior post. I don't think Janice ever claimed that NSS did not exist at all. I could be mistaken, of course.
Received a call today from TD Waterhouse telling me that if I have received or may receive a notice of lawsuit against myself and other shareholders of BCIT filed in Oklahoma court to disregard it as it has been dismissed as of May 11th in same court. I said "You're four days too late and four notches too happy. Now pay up". He said "Pardon?". I said "Never mind, I have to go. Thanks, bye." LOL
zxc, in your example, it is the merchandise which customers bought from the shop owner which is counterfeit, not the money used to pay for that merchandise. The shop owner in our case is suing every customer who bought anything at his shop in the last year of business, claiming that they (the customers) are responsible for the merchandise being stolen goods to begin with... even though he knows precisely who originally acquired that stolen merchandise and even though the shop was being run by a burglar at the time. Oh, by the way, he already successfully sued the burglar and got compensated there.
In the real world, in your example, the shop owner would have been up on suspicion (or even charges) of fraud alongside the burglar who was running the shop at the time of the shop owner's absence. The burden would have been on the shop owner to prove himself innocent. But this ain't the real world, is it now, ladies and lads? This is Pinkyville!
That's the problem with this case - people constantly and continually have it upside down backwards. :|

Wow, that's sound advice "If you don't like a lawsuit against you, ignore it". LOL. I plan quite the opposite, really, if and when I receive this "letter". Right now I'm only interested in finding out once and for all if something is indeed headed my way, since I have yet to see/hear my name on any of the lists mentioned/posted.

The Canadian summons is ten times worse than the American one. At least in the American, the floor was open for the "defendants" to devise an answer on their own. Canadians are being herded into a carefully revised trap with only one option presented under the guise of THE saving grace. The brit must think our brains are frozen up here.

There is nothing new and positive in that. The first letter is about past dismissal of 2-5. The second is a cover letter outlining the next proposed action and the third is the form to proceed with that action, i.e. to dismiss the case against us through invalidating our shares. Where's the good news?

I would take any lawyer firm's expressions of outrage with a grain of salt. Examine your positions carefully before you jump onto another lemming wagon, as it may prove to be the proverbial leap from the frying pan into the fire. I'm not implying any mal intent on the part of this law firm. Rather, just a word of caution in an already volatile situation where group think may get the best of you, your money and your future position. Lawyer firms are a business, after all. The best firms don't seek you out; you seek them out. IMHO
