Believe the myth if you choose to, hege, but all the data says that delivery fails in the OTC markets are both financially and numerically trivial in addition to being transient. They have, in addition, declined dramatically since SHO imposed delivery requirements on MM's. There has never been any evidence of a long term "naked short" in any OTC issue.
Amazingly, nemo, it is legal. And there seems to be an endless supply of suckers willing to chase the dream.
Midway was, BTW, a big "naked short" claim, heavily promoted by ScamWire.
It's allowed, gump, but you have to find a boutique broker who will mess with it, and the cash margin requirements ($2.50 per share in the US) make shorting sub-pennies economic stupidity, unless, of course, you hold a CD. In that case it's considered a hedged transaction and the only security needed is your pledge of the CD.
BRGE and a couple of other regional broker dealers specialize in disposing of stock on behalf of CD holders. They sit on the ask and receive a 10% to 15% commission.
