Large Canadian cannabis producers have reported billions in losses since Canada legalized marijuana in late 2018.
In 2019 alone – the first calendar year recreational products were allowed to be sold – collective net losses exceeded CA$6 billion.
But the deficits come as Canada sets records for adult-use cannabis sales almost monthly – evidence that the problems emanate from the businesses’ boardrooms, and their struggles should not be considered representative of the Canadian industry as a whole.
In an effort to rightsize their operations, more than 3,000 jobs have been eliminated by a handful of companies, and their cultivation footprints have been seriously curtailed.
The closures came after the industry significantly overshot the production capacity needed to meet demand in Canada’s expanding adult-use marijuana market.
Canopy’s Klein did not waste time after taking over as CEO at the start of this year.
Klein immediately launched a restructuring plan that ultimately led to about 1,000 job losses and shuttered facilities across the country.
But the company’s fresh focus on beverages, an unproven niche that accounts for a tiny fraction of industry sales, is risky, analysts say.
‘Not surprising’
Michaela Freedman, an international cannabis business consultant and founder of Toronto-based MF Cannabis Consulting, said Canopy’s troubles are symptomatic of a company that tried to “do anything and everything.”
“Internationally, they were buying up and building facilities from scratch, not really understanding the market – of course, because there wasn’t one,” she said.
“They didn’t take the go slow approach like some good businesses do.”
After a global expansion spree in 2018 and 2019, Canopy has spent 2020 in full retreat.
In May, Canopy ceased cultivation in some parts of Africa, Canada, Colombia and the United States.
Canopy was among the Canadian producers – like competitor Aurora Cannabis – that had invested heavily in far-flung areas of the world where real medical marijuana markets remain years, maybe decades, away.
“I think Canopy is finally accepting the repercussions of their terrible business model, and I think they probably should have closed down some of these facilities and rolled back some of their foreign engagement a lot sooner,” Freedman said.
“It’s unfortunate, but I think a lot of people have learned from Canopy. I think we’re going to see a lot of better businesses.”

Soon after cannabis products started flying off shelves following legalization, Canopy Growth Corp. had a $26.9 million problem.
The Smiths Falls, Ont.-based company told investors and analysts during a November conference call to discuss its financial results that it was grappling with $20.5 million worth of product being returned from provincial retailers and bracing itself for another $6.4 million worth that was on the way.

The incidents are a peek into the little-discussed world of cannabis returns, where products are sent back to companies over everything from lack of sales to consumer complaints and quality concerns. Because companies and provincial cannabis distributors track returns differently and don't always disclose data, it's hard to know how common returns are, but experts say returns are more often an issue between retailers and wholesalers than consumer complaints.
Jordan Sinclair, Canopy's vice-president of communications, wrote in an email that the capsule returns his company faced came because the products "didn't catch on in the recreational market as quickly as we had anticipated in part due to slower store rollout."
"We're viewing these things as natural friction as consumers and retailers provide their feedback," he said. "This is a new market and we are still learning about customer preferences and how they differ from province to province.
Some predict the number of returns like Canopy's may be exacerbated by a predicted oversupply of legal cannabis and the second wave of products like pot-infused chocolates, cookies, soft chews, mints, tea and vapes to hit the market.
"We are in the process of seeing the first wave of returns," said Robyn Rabinovitch, Hill+Knowlton Strategies's business strategy consultant for cannabis clients, who has worked for CannTrust Holdings Inc. and TerrAscend.
"As we get into more robust offerings...and additional product categories, I think there is a risk of some of the slow-moving product on the 1.0 side being returned to licensed producers just to free up space at the retail and wholesale level."
Rabinovitch has noticed that consumers are clamouring for products that have the lowest cost, but the highest potency. Their habits have sometimes left products with less than 12 per cent tetrahydrocannabinol -- the cannabis compound producing a high -- on shelves.
Greg Engel, chief executive of Organigram Holdings Inc., said he has yet to see anything that makes him feel product that isn't selling will be returned to make up space. For now, he says industry returns have largely come from slow moving products.
"Now that next-gen products have launched many provinces and retailers are considering a SKU rationalization process to assess their current category mix," he said. "Generally, these processes result in depleting existing inventory versus returns."
But products returned because they don't sell are only one part of the problem facing cannabis companies.
There have been recalls, like the voluntary one that occurred in November 2018, when RedeCan Pharm received complaints that some of their products contained mould.
Vaughan, Ont.-based CannTrust Holdings Inc. was subject to massive returns when millions in product was shipped back after it was disclosed the company grew some weed in unlicensed greenhouse rooms.
Cannabis stores across the country are also encountering situations when products arrived late to customers, shipments are undeliverable, items are damaged or not as ordered. Sometimes returns happen because buyers simply have had a change of heart about their purchase.
"I have heard there are some issues in quality with some licensed producers...but we don't really get a lot a lot of returns," said Marianella delaBarrera, WeedMD Inc.'s vice-president of communications and corporate affairs.
WeedMD returns are "atypical," she said. The company only gets one or two a month and most come from products being undeliverable.
Recalls, empty containers and dry products make up the top reasons for returns related to quality at the OCS, said Bin Mathew, the agency's quality assurance lead.
Between May 2019 and the end of January, the rate of return was 0.04 per cent, down from 0.27 per cent between October 2018 and May 2019.
"Being a new product and a new industry, we thought (we would see) high numbers," Mathew said. "We've seen a significant decrease... it was a learning curve."
Licensed producers are required to retain all returned products for two years for testing purposes, after which they are free to destroy it as long as no one is exposed to cannabis smoke in the process and two people are on hand to witness the event.
Health Canada said since October 2018, the reported quantity of dried cannabis destroyed per month has averaged 11,152 kilograms. As the number of licensed cultivators has increased, the total weight of cannabis destroyed monthly has trended upward, but the percentage of crop destroyed has remained relatively consistent at about four per cent of licensed cultivators' inventories.
Federal regulations allow companies to get rid of the substance by incinerating it or shredding it and mixing it with other types of inorganic material before composting or disposing of it through local waste removal services.
Companies are turning to third-party disposal companies to free up space or compost methods, a switch from earlier days of the industry, when Rabinovitch noticed a novel approach was popular.
"You would go purchase kitty litter. You would add water to the material and then be able to throw it out in traditional methods, confirming that no one would be able to dumpster dive and be harmed by the consumption of those materials," she says.
"But kitty litter is not always the most efficient and cost effective method."

Supply-demand imbalance grows for Canadian cannabis edibles
Makers of edible cannabis products in Canada continue to stock more goods than they’re able to sell, the latest data from Canada’s cannabis regulator shows.
In August, federal license holders, provincial distributors and retailers held almost 10 million packaged units of cannabis edibles in stock, including beverages.
That compares with sales that month of roughly 1.42 million units in medical and nonmedical channels, per the Health Canada data.
The inventory growth is entirely attributable to producers.
Federal license holders held 6.6 million units of edible cannabis products in August, up from 5.2 million units in July.
At the same time, retailers and provincial distributors drew down their aggregate inventory, even as the number of retail points of sale expanded.
Provincial distributors and retailers held roughly 3.1 million edibles products in August, down from 3.2 million the previous month.
The inventory build comes as sales growth steadily falls.
The 1.42 million units sold in August was 6.8% higher than July’s reported sales – about a third of the growth for the June-July period.
August sales growth of edibles cannabis products was the lowest since the products started hitting the market in late 2019.
On a dollar basis, sales grew in several of Canada’s key markets, according to data from Seattle-based cannabis market intelligence firm Headset.
For August, Headset’s data shows edibles sales reaching 5 million Canadian dollars ($3.8 million) in Ontario, British Columbia and Alberta.
That’s up from CA$4.7 million in July.
The Ontario data excludes sales through government-run online monopoly Ontario Cannabis Store.
Sales of cannabis extracts such as vape pens, hash and softgels barely rose from July to August on a packaged unit basis, the Health Canada data shows.
About 1.4 million units of extracts were sold in August, while inventory exceeded 10 million units.

A decision on June 26 by Mr. Justice Robert A. Graesser of the Court of Queen’s Bench of Alberta has determined that Health Canada’s cannabis regulations violate section 7 of the Charter of Rights and Freedoms in two critical areas that the Victoria Cannabis Buyers Club has been arguing. Defendant Shaun Howell hired top-notch lawyers Jack Lloyd and Paul Lewin after being arrested in March 2017 in his cannabis production and processing facility near Innisfail. Alberta. Though the crown is expected to appeal the constitutional decision and the defense is preparing to appeal the sentencing, this critical judgement significantly helps the VCBC stand its ground.
Enough cannot be said about the quality of the evidence presented by the defense, with both expert and patient witnesses submitting concrete evidence that was mostly uncontested. In contrast, the crown once again did a spectacular job failing to defend regulations in court, similar to the infamous 2015 Smith trial. Ultimately, the judge could not deny the significant problems that continue to exist in the federal medical cannabis programs, given the well-documented failings of that system and the lack of evidence to justify restrictive regulations and cumbersome bureaucracy.
While Mr. Howell still may face penalties if the sentence is not overturned, he is clearly happy to see the bulk of his arguments win the day. “I am pleased to see the limits on edibles fall. I think that is a huge win for patients. The other part of the decision to constitutionally mandated medical storefronts, is also a big decision. Patients rights to access have been seen and upheld by Judge Graesser.” While the current cannabis industry is too wrapped up in a host of problems to fully appreciate and acknowledge the significance of this judgement, no doubt the Howell decision will be the next step in a long line of historic cases that have forced the government to improve its medical cannabis policies.

Biden says he won't legalize marijuana because it may be a 'gateway drug'
Do you really think Biden has changed his mind on cannabis in a year? really, Prohibitionists don't change their minds on cannabis.
“The truth of the matter is, there’s not nearly been enough evidence that has been acquired as to whether or not it is a gateway drug,” Biden said, according to Business Insider. “It’s a debate, and I want a lot more before I legalize it nationally. I want to make sure we know a lot more about the science behind it.”
Biden, as he has throughout his time on the campaign trail, said he supports medical marijuana and insisted possession of the substance "should not be a crime."
But he also said Saturday that he thinks the decision to legalize marijuana should be left up to individual states.
“States should be able to make a judgment to legalize marijuana,” he said at the town hall.
As for legalization on a federal level, Biden said more research is needed.
"It is not irrational to do more scientific investigation to determine, which we have not done significantly enough, whether or not there are any things that relate to whether it's a gateway drug or not," Biden said.
Several of his top Democratic rivals in the race have thrown their support behind legalizing marijuana, which is currently classified as a Schedule I substance, which the Drug Enforcement Administration defines as drugs “with no currently accepted medical use and a high potential for abuse.” Other Schedule I drugs include heroin and LSD.
Biden’s campaign previously noted the former vice president would reschedule the substance as a Schedule II drug to aid in researching its health impacts.
Sens. Cory Booker (D-N.J.), Elizabeth Warren (D-Mass.), and Bernie Sanders (I-Vt.) have all said they would make marijuana legal on a federal level if elected president.
Democratic presidential candidate Andrew Yang in a tweet Monday morning said he believes marijuana should be legal throughout the country, a position he has held since releasing a plan that would pardon individuals who are imprisoned for nonviolent marijuana convictions.

Ontario government’s cannabis Crown corporation lost $42M in latest fiscal year

Ontario Cannabis Retail Corp. lost $42 million in the latest fiscal year, according to newly released public documents.
The provincial Crown corporation tasked with online sales and wholesale distribution of recreational pot reported revenues of $64 million for the year ended March 31, 2019.
However, Ontario’s consolidated financial statements show the OCRC, which operates as the Ontario Cannabis Store, racked up expenses totalling $106 million during the period.
Canada legalized cannabis for adult use on Oct. 17 last year, and the rollout was mired by supply chain issues and product shortages, which largely have been resolved in recent months.

Crews were called to a massive fire at a former cannabis greenhouse complex in Delta, B.C. Sunday morning.
Crews were called to the facility near Highway 99 and Ladner Trunk Road around 7:30 a.m.
Delta Fire Chief Dave Wood said crews were able to knock the fire down, and contain it to a warehouse complex attached to the greenhouse.
At the peak of the fire, about 30 firefighters were on scene, he added.
The facility was operated by BC Tweed, a cannabis grower that shut down operations in March, Wood confirmed.
A massive plume of black smoke, described by some on social media as a “mushroom cloud” could be seen from several kilometres away.
Delta police said there were no initial reports of injuries from the fire.

For over 25 years, the Victoria Cannabis Buyers Club has been advocating for the rights of medicinal cannabis patients and filling in the gaps in the system. Over the years, the illegal compassion club VCBC has survived through 8 raids, the last two being recent. While they have changed the law as they blaze the trail, the battle has been long and hard.
The reality of the situation has been and is that the illegal compassion club VCBC is under serious threat. But, there is always a reason to hope if you can hold on long enough… Thankfully, the Victoria Cannabis Buyers Club just got some good news from the Province. A step in the right direction, here is an outline of the situation and the new details that you need to know.
Why can’t the illegal compassion club VCBC just comply and ‘go legal’?
Currently, we have recreational cannabis regulations but medical cannabis has yet to be worked out. A huge reason for this is the fact that Health Canada has not completed long-term human studies. Without any medical backing, the government doesn’t know what to do with medical cannabis access. In their ignorance, a licensing system has been created that favours money, not experience. Medical patients are expected to register with a single licensed producer or go to a retail store, leaving them without affordable access to:
High dose edibles and variety – something critical when dealing with dietary conditions
Cannabis suppositories
Higher dose cannabis products such as capsules
Cannabis concentrates and topicals
Specific strains that their system needs
Who can’t go to a Licensed Producer?
From the outside looking in, it’s easy to think that someone with a serious medical illness could just go to a licensed producer. However, there are many other factors that can create serious barriers and when it’s your medicine, it means your health. Licensed Producers are not accessible for people who:
Don’t have a credit card or the ability to pay online – This could be due to their medical condition or financial situation.
Don’t have a family doctor or health practitioner willing to sign their cannabis prescription.
Can’t afford the high costs associated with LP’s.
Don’t have a secure mailing address.
Need emergency medicine.

The needs of medical patients cannot be met under the current licensing system. In the meantime, places like the VCBC have defied the law in remaining open. But, when it literally means life or death, it’s the only just thing to do.
The last two raids
On November 14th of 2019 and July of 2020, the Victoria Cannabis Buyers Club was raided by the Community Safety Unit. During each raid, thousands of dollars worth of cannabis and cannabis products were seized. For a non-profit that makes its own edibles, the raids were devastating. Nevertheless, they persisted. Despite their losses and remaining threats, the VCBC re-opened within 24 hours of each raid.

Regardless of the fact that they don’t fit into the current model, the VCBC provides an essential service. A sweeping exemption to the Cannabis Act can be granted if awarded by the Governor-General. This is what the VCBC wants but to obtain an exemption, you need to have a lot of political support. Thankfully, their struggle did not go unnoticed. In January 2020, a letter was sent from Victoria City Council to Minister Farnworth; after the council voted to support the VCBC unanimously. In it, they expressed their support for the VCBC’s exemption request. Even so, the club was raided six months later.
Surprise support from the Province
At the end of August, Victoria Mayor Lisa Helps received a letter from the Minister of Public Safety and Solicitor General, Mike Farnsworth. The first thing addressed in the letter is the delay in his response; apparently, there was a misfiling. After, there are a couple of paragraphs explaining the provincial position when it comes to Medicinal cannabis. However, it goes on to express support for VCBC.
“That said, I have raised this issue with my federal ministerial counterpart and encouraged exploration of a license that could allow VCBC to continue providing certain services. The Province has also urged the VCBC to contact Health Canada about licensing and informed them they may want to share their views about enabling medical users to access cannabis through a storefront. The City may also wish to share its support for the VCBC model with Health Canada at cannabis@canada.ca.”
The Current Situation
The Victoria’s city council officially received this letter on September 17th. Following that, they unanimously voted to send a new letter to Health Canada, asking for special consideration for the VCBC. In the meantime, there is no further word from the province or assurance that their operations can continue, without fear of penalty.
VCBC needs your help!
This battle is far from over and The Victoria’s Cannabis Buyers Club needs all the help they can get. By the end of next month, a package of documents is intended to be submitted to Health Canada. Right now, the club is collecting:

affidavits from professionals
reports from licensed cannabis companies, describing the difficulties they have had with the current regulations.

You would think that living in Canada equates to access to medicine, especially when your life depends on it. However, this is a tragic misconception when it comes to medical cannabis.
