MIAMI - A fierce legal dispute that began two years ago in a Miami-Dade courtroom dealing with a Cuban music festival ended on Monday evening with a verdict in favor of the festival organizers.
The festival was to be held on April 9, 2011, with more than twenty artists from within and outside Cuba. The center of the dispute arose when the directors of Homestead-Miami Speedway decided to cancel the event. They argued that the organizers were planning an activity of Cuban music and not Mexican.
The decision to set aside the festival was taken after the signing of a contract for renting of the speedway.
Organizing a festival with Cuban artists backed by the government of the Castro brothers led to exile protests in South Florida. Miami-Dade Commissioner and former Homestead Mayor Lynda Bell joined the wave of criticism.
The trial was aired in a court presided by Judge Sarah Zabel. A jury of four men and three women decided on the case, which included a claim for damages brought forth by the company MIA Resort, Luis Arias, and music promoter Hugo Cancio, of Fuego Entertainment.
The judgment requires the Speedway’s directors to pay a financial compensation of $567,000. The jury concluded that the allegations submitted by the managers to support its decision to ignore the lease and reject the plans of entrepreneurs were insufficient.

“I love Americans traveling to my native country, so it came to me: It’s time for us to put together a magazine,” said Cancio, who arrived in the United States in 1980 — at the age of 16 — and has been back to Cuba often. Cancio, a longtime anti-embargo activist, is a music promoter who’s brought big-name Cuban artists like Silvio Rodríguez and Los Van Van to the United States.
One year ago, he and New York attorney Antonio Martínez formed a political action travel ban.
To get OnCuba off the ground, Cancio assembled a team of writers, photographers, editors, designers and translators in Cuba led by veteran magazine editor Tahimi Arboleya.
Their aim: to share the mystery and allure of Cuba, as Arboleya puts it in her first editor’s column. That includes culture, history, nature, daily life and travel. There’s a guide to currency exchange and Customs issues. Plans call for a business section soon.
Advertisers in the first edition are charter flight operators, Miami companies that ship freight to Cuba, restaurants in Havana including Paladar La Guarida and Café Laurel, and some of Cancio’s own ventures: consulting company Cuba Business Development Group and mobile telephone business Mascell.
Cancio said a full-page ad in OnCuba now retails between $1,800 to $2,000, but prices will vary based on the number of editions booked and on magazine volume.
He’s hoping to expand circulation to more airlines that serve Cuba and plans to speak with Cayman Airways, Cubana de Aviación and others for placement on their flights.
“Our long-term goal is for this magazine to become the magazine for all travelers to Cuba,” he said.
Initial reaction to OnCuba has been positive. Readers said they like the timely content and artsy photos. But questions surfaced about its financial viability.
The magazine must print different versions for competing charter companies. It will depend on ads mainly from a limited pool of U.S. companies that serve tourism to Cuba.
And some wonder how many Cuban enterprises can afford its glossy ads.
Cancio says he’s looking beyond the print edition to draw readers and advertisers. His team has also launched a website, Facebook page, Twitter account and YouTube channel to engage audiences.

Cuban émigrés call for more involvement in the country Miami Herald

A weekend meeting of Cuban diplomats and émigrés in Washington heard calls for the Raúl Castro government to allow the émigrés to return, invest and buy property in the island just like any resident, participants said Tuesday.
The by-invitation-only gathering of about 115 Cubans living in the United States issued a final declaration that hewed closely to the topics mentioned in the invitations issued two months ago by the Cuban diplomatic mission in Washington.
It demanded the end of the U.S. embargo and all other sanctions, the release of five Cuban spies convicted in South Florida in 1998, the island’s removal from the U.S. list of countries that support international terrorism and an end to Washington’s financial support for pro-democracy programs in Cuba.
Among other items, it also urged the U.S. government to extradite Cuban exile Luis Posada Carriles to Venezuela to face terrorism charges and eliminate the Cuban Adjustment Act because it spurs illegal migration to the United States.
But some participants said that during the closed-door meeting several émigrés urged Havana authorities to give Cubans living abroad the same rights as Cubans living on the island. They said they prefer “émigré” over “exiles” to avoid any political connotation.
Most Cubans living abroad now need Cuban government permits to return to the island and are not being allowed in most cases to buy properties or invest in businesses under their own names. The U.S. embargo also limits Cubans living in the United States.
Cuban officials told participants at the conference Saturday that the government is “on the irreversible path to normalize relations with the émigrés,” said Hugo Cancio, a participant and Miami music promoter who owns Fuego Entertainment.
Cancio added that if the Cuban government does offer more equal treatment, the U.S. émigrés are likely to become more active in opposing U.S. sanctions on the island.
Castro and other island government officials have spoken several times about the need to improve relations with Cubans living abroad and to change the laws and regulations that control emigration as well as the rights of émigrés.
But several days when the official announcement of the reforms was expected have come and gone without a word. Unconfirmed reports now making the rounds of Havana say the changes may be unveiled at the mid-summer meeting of the legislative National Assembly of Peoples Power.
Sympathizers say Castro wants to correct past wrongs and promote reconciliation with Cubans abroad, while opponents complain that he only wants their money because of Cuba’s dire economic straits.
