I see no basis for a lawsuit. But for some reason MrsDoubt seems to think there's a possibility of a lawsuit and that if Shupin won a few million bucks he'd share the money with shareholders.
From my perspective, that's not even a longshot....it simply is not going to happen in any way, shape or form.
Doubt: Lets pretend Shupin were to win a lawsuit from the old owners for $3 million. Are you really that naive to think Shupin will have pity on shareholders, take his $3 million and divide it equally among you?
Not! It'll be his money to do with as he wishes. No stock ever moved because an EX-CEO got some pocket money from a rival.
Actually, I don't think you're that naive. I think you like having fun with the other shareholders on this board with your sense of humor.
I'm sure you know by now that the $16 million was NOT revenues but rather a figure that appeared in the financial statement that Scar and others used to make you believe there was $16 million in revenues.
Looks like I sold my remaining shares just in time. Finally, a little luck was on my side.
I held on to a shell for a year and a half once. Nothing happened other than one disgruntled shareholder kept us up to date on the legal happenings of the crooks who scammed us.

jk: Averaging down doesn't make much sense in this scenario. It's one thing to know that you're invested in a viable company who has ups and downs.
It's quite another to sink your money into a company that's starting from nearly zero whose intentions and options are unknown.
MrsDoubt: The out of court settlement turned out to be wishful thinking.
All that is past history. Now it's time for Shupin to roll up his sleeves and rebuild this business from the ground up.
Lets hope that a reverse split is not part of the process.
We need a PR before the end of the year stating position/progress and a decent forward looking statement. I'm not expecting reports of earth shaking proportions, just an honest assessment of where we're at.
If no PR, I think I'll move on, sell my shares and take the loss on my 2011 taxes.

You sold your shares but believe something good is only 2 months away?

Dejong: Think of it this way. When a company increases the number of outstanding shares it dilutes the stock and the price per share goes down.
The more shares outstanding the harder it is to move the PPS upward. Why? Simple supply and demand. If there's a huge supply of shares when good news strikes there's shares enough for everyone. However if there's only a few shares when good news hits then bidding for the shares gets frantic with not enough to go around. At that point the PPS starts to skyrocket as everyone is vying for the few shares available.
Example: Lets say you and 24 other people just spent 2 weeks in the desert without water. Finally you're rescued but the rescuer only brought two bottles of water. How do you think the bidding might go between the 25 of you for the two bottles of water. Would you offer $10, $25 or $100 for a bottle?
Now what if your rescuer brought along 1,000 bottles of water. How much do you think a bottle of water might cost you in this instance. Probably $2.50 a bottle, because there's enough for everyone.
So, we want low outstanding share counts when good news hits.
Dejong: Here's the thing.....
After the last PR, there isn't enough information to give a hint as to where this will go.
Lets be frank. Shupin is picking through the rubble of his business trying to figure out what his next move is. Until we get a PR hinting at a new focus, as well as a positive forward looking statement, we'll churn at these levels for awhile. Also, as I said before, if the funding for any new venture is tied up in a successful case against Hoffer, we'll be waiting for a long time.
When will I sell? Well this has become much more interesting than the money involved. So for now I'll hang on to what I've got. Now that we know that Shupin is trying to resurrect the business there's little point in selling at this time.
At what level will I sell? Anything between 002 and 004 is looking pretty good. However if Shupin happens to surprise us at some future date I'll reserve judgement for higher exit levels. Conversely if this starts moving on hype and silly PR's I'll dump as soon as the PPS doubles my money or better...typically in 1-2 days!
How many shares do I own? That stays private.
The DOW is down by 3.5% but ADSV is up by 20%.

Kurt: Volume will come when we get a PR stating the new business direction and what reorganization efforts have been made.
Personally, after reading today's PR, I'm not expecting much in the next 6 months. Frankly, these guys are starting from scratch, searching for a way out of the woods.

Chuck: This is the PR I was looking for. It's content is exactly what I expected if we were going to hear from a company that no longer is what it used to be while also hinting at a possible future.

Finally, confirmation that the company isn't entirely dead and that the owners have not yet capitulated to defeat.
Amen Dejong: We need information on their new direction not a regurgitated PR from May the 5th which predates the outcome of the court cases.
If we were going to get a PR similar to this I fully expected it to state the new business direction and name of the new business.
If this PR is true, in the literal sense, they need to inform investors how they retained the business when court documents and PR's from other entities indicate otherwise.

Blackcat: I'm confused. Everyone who's been in ADSV for awhile knows that this PR was indeed posted on May 5th. This is a cut and paste of the May 5th PR. This is not a new PR.
What exactly are you saying? Are they repeating the May 5th PR as updated information, indicating that nothing has changed? If they are, I'm here to inform you that much has changed since May the 5th.
They don't even own the company they mention in the PR anymore, however this PR would have you believe they do.
What the heck is going on here? Chuck, can you provide some clarity?

I don't put much stock in a future court case, however if I'm going to hope for something it'll be that Shupin reinvents himself and comes up with another business venture that seems solid enough so investors will be excited.
Add some time and patience if funding for a new business is to come from winning a court case against Hoffer.

We all suspected (just not confirmed) that Shupin held on to ADSV but the big question is, "What the heck sort of business are we invested in?" ADSV, without a business to go with it, is just a useless shell.
If ADSV is going to come alive then Shupin needs to reinvent himself and his business. We have to hear from him in a PR announcing his new business direction. After that the market will take it from there.
Lastly, did you speak to Shupin or was it the receptionist that led us astray just before the collapse?

You're still not convinced that the trial is over and Shupin lost the company to Hoffer?
Here's how it went down:
1) Shupin decided to withdrawal his case against Hoffer.
2) The judge recognized the fact that Shupin had no means to pay Hoffer.
3) Shupin lost the company to Hoffer.
4) Shupin never filed an appeal in the required time.
5) Shupin never filed an extension for filing an appeal in the required time.
6) Shuping completely gave up. The deal can't be undone.
7) Hoffer turned around and sold the company to NovaVision which is a privately owned company. The quickness of the sale indicates that Hoffer was planning his endgame strategy for awhile.
PACER has all the court documents that outline the entire trial from its hopeful start to it's unexpected and sad ending.
At this point in time your only hope that something may happen with ADSV is if Shupin still owns it, is working on another business veture and one day attaches it to the shell that ADSV has become.
If that day ever comes, be prepared for a name change on the stock and some sort of reverse split to shake the tree of dead wood and to secure a higher PPS for future investors.
I don't mean to rock your world MrsDoubt, but your rent money is going to take a long, bumpy road in coming back to you......if ever at all.

Scar/Smartmoney has left the building on an investment that at one time he pumped as being the play of the year.
In my opinion, the 16 million trade day we had a week ago was either Shupin selling and collecting about $60K or Scar breaking even, finally admitting defeat after a complete and utter missed call.
Dejong: How can the company still be alive if Shupin lost it, Hoffer sold it and the current owner, NovaVision, is privately held and not a public company?
Of course you're free to spend more of your money but allow me to tell you about the gamble your taking...
What your really investing in is your belief that Shupin somehow retained ownership of ADSV, is building a new company with money he doesn't have and will finally attach that company to ADSV so we can start getting PR's to raise the PPS where you'll make millions.
Seems like quite the long shot doesn't it?
More than likely Shupin is in the unemployment line collecting his check and sending out his resume to other companies like the rest of us shmoes.
In my humble opinion it's game over. Look what just happened.
1) Hoffer took back his old company
2) Hoffer sold the company. He's no longer the owner of our old company nor responsible to ADSV sharholders: "Mr. Hoffer will remain as a product and security consultant to CGM-NV and serve on the Board of Directors."
3) The company he sold our assets to is not a public, trading company. It's privately owned. Check out their website. I don't see any mention of NovaVision being publicly traded. Peruse the site for yourself: http://www.novavisioninc.com/
In my opinion, our company is now in private hands.
I believe our shares are worthless and the company we once believed in no longer exists.
No news from Shupin about ADSV
No news from Hoffer about ADSV

More than likely the 16 million traded the other day was an insider looking to cash in before the news broke.

For kicks I tried to send an email to Shupin this morning. When I did I received the following message:

* Glass is half full interpretation: Shupin is so busy creating a new business for us share holders that he has no time to respond to his email messages.
* Glass is half empty interpretation: Shupin stopped responding to his emails. He has no interest in reading them because he no longer owns a company where he has to respond to customer/shareholder inquiries.
If you still owned a company would you let your email box become so full that customers couldn't connect with you?

How about....almost 2 months with no news.
We need some news that ADSV is alive to move higher.
With positive news comes higher volume followed by an uptick in PPS.
No news = low volume and low PPS.
That's my input.

News on the trial? The court documents have all the news your looking for. They won. We lost.
As far as financials and the company being fully operative, lets just say that Shupin's silence is speaking volumes. If he really owns a company and it's still viable he needs to grab his sword and start swinging at what Hoffer posted on his website.
To hear Hoffer's version, he (Hoffer) now owns our company, is taking orders and Allied Security Innovations, Inc. no longer exists. The longer Shupin remains silent the darker our outlook becomes.
