Thank you for asking. I believe there are 3 possible outcomes in the near term (next 6 months) for the Nevada case.
1. J&J could win their Motion for Dismissal. The judge may believe their pleadings. If this were filed in the San Fran Federal Court their chances would be 70/30 in favor since we all have the benefit of having seen Judges Davilla and Orrick in action. But this case is in Nevada and a lot of time has passed without a ruling. So, at this point I rate it at 15% that J&J prevails outright on their Motion.
2. DECN wins J&J's Motion. The case proceeds, J&J has to answer the suit, but they already have in their Motion, that would have been decided in DECN's favor. That would not be good for J&J. They in effect would be dead. A BIG gamble would have blown up in their faces. At that point they would immediately file an IPR with the USPTO and move to stay the case in Nevada while they attack DECN's two patents. That would delay the Nevada action for 12 -18 months, but an IPR would be another BIG gamble for J&J. I give this a 45% chance.
3. This is something that my partner came up with that has in the past two weeks rocketed up in my odds making. I sat in on a conference call with several attorneys in Washington, DC as my partner presented his theory.This scenario in my mind is now up to 40% and growing. Here it is. My partner and the Wash. DC lawyers believe that J&J made a strategic error by filing for a Motion to Dismiss, but writing the Motion in such a way that it reads like a Summary Judgment. They incorporated expert testimony, among other things, from the California cases. The Wash. DC guys believe that Judge Boulware will convert the Motion into a Summary Judgment request, and then deny it. Summary Judgments typically substitute as trials. They are in a sense a mini-trial before a judge. If this occurs, the case could be over before J&J even answers the suit.
Great find!! However, I don't think we see any announcement on this. My gut tells me JnJ is still trolling around DECN customers and potential customers. Hopefully we see this in their next financials. I'm more than happy to wait around and see.

Pluto-I'm sure the Big 4 are aware this is coming, therefore, why not acquire DECN now? Why not sell to a JnJ opponent and allow them to gain additional market share through the Gen family? I would also assume they do not wish to fight a lengthy legal battle with DECN, especially with the recent DECN win. Any thoughts would be appreciated. Thx

IMO-Pricing is perfect with Free Shipping. You are correct, they need some verbiage on the initial Genultimate page that states it's use with the JnJ meters. Also, the picture is a little blurry. They need a super high res photo to capture people's attention. However, I'm just glad it's up there. It's not an easy task, especially when you still have JnJ breathing down your neck.
I tried posting a photo used a while back of a side by side comparison of genstrip50 and JnJ strips "us and them" but was unable to. I'm not to sure of the legality of this but it's a genius marketing tool. If you go to Genstrip50 twitter page and look under media you will be able to find it.
Also, I just wanted to say thank you for always refuting these nasty people here on Ihub. It's a job in itself.

Walmart is deviating from brick and mortar and pouring money into online market. I think we see Genultimate online within the next couple of weeks. We are on the right path!!

Accumulation from weak hands to strong hands!!
IMO-In the past couple of weeks there has been a big shift in the accumulation of shares from weak hands to strong hands. This decline has fortunately allowed DECN to regain the support of some new and currently longs including myself. Patience will ultimately prevail for shareholders who continue to support and stay committed to the end goal. Through RM, Genultimate! Will be on shelves in due time. We also learned this morning that DECN is and has been eagerly navigating its way to an up-list. This will allow funds to aggressively start investing as well as remove any stigma attached from the pink sheets. I also believe people to tend to overlook the massive Nevada case currently playing out. People are underestimating the magnitude of the worst case scenario not to mention the different stratosphere DECN will be in if the case goes as planned. I’m extremely confident that management will reward their loyal and devoted shareholders.

Crony-Of course you would like to obtain the highest profit margins possible. Therefore, I believe management is fully aware of their sales margin formulas and where they need to be when dealing with Walmart. To be clear though, Walmart is not the only plan of attack. There are 16 other big box stores on the radar along with 1,000's of pharmacy chains. IMO

Correct Keeps...this type of sales product is minimum 3 months and private label could be up to year. I believe we see Genultimate in 2-3 big box stores before year end. IMO
780 million shares is absurd. You have to be kidding? IMO they are 110 million fully diluted, If not less. Please keep in mind that's nothing with a 4 year litigation to keep up with. But that bleeding has stopped and now it's time to sell sell sell...

I don't believe management should be a concern. This is what we know thus far:
1.California case is settled
2.JnJ paid a cash settlement
3.Mandate was issued
4.105 is invalid
5.DECN purchased a big order of Genultimate.
6.Retail Monster is hard at work
7.Nevada case is moving along.
This is just the beginning of a truly once in a life time opportunity. DECN is in a great position. I'm sure management will issue a PR in due time.
I went on the low end as DECN has not shown proof of sales at this moment. I believe the purchase price will increase as time increases. Retail Monster will have them in a minimum 3 box stores before year end. I think Retail Monster is being underestimated by many. They may have only been in business for year, however, their contacts are unmatched. There is no hitting the pavement for them and going though the mill of low level buyers. It's a phone call to a top executive and in they go for a pitch. Obviously this all IMO..
JnJ’s market cap has topped 308 billion this week. To this day I still can’t figure out why a buyout has not taken place. Of course JnJ’s arrogance blinded them for the last four years, however, after several historical victories in the past month or so one would think it’s inevitable. IMO once DECN contracts with a big box and/or a pharmacy chain it will be the nail in the coffin and the Nevada case will be settled with a buyout via stock-for-stock purchase. What is another 1.8 million JNJ shares when you already have close to 3 billion OS.

IMO the settlement will be sealed and Sealed means Sealed!!! If you want cash from the enemy you must keep it to yourself;) DECN is in the best position they can possibly be in at the moment. They have a sourcing Giant in Retail Monster, they have free range to sell product, and they have cash to do it. O yea and JnJ is infringing on their patent worth 400-700mil.

IMO DECN settled for a cash sum, therefore, the case is closed regarding the bond and/or any future appeals.

I completely agree with in regard to TAUG. Do you think there was some type of financial settlement with a clear path to sell product? Seems like the census is a buyout, however I don't think we are there yet.
