Strikes me as comical and ironic that Ryles is now on the same team as Philips. True, his gripe is against CDEX no matter who is now running the ship. He just wants his money no matter who F'ed him over.

There are an endless number of explanations that would explain the latest Ryles matter.
I doubt Ryles was paid off. I also doubt that Ryles got cold feet. There is no question in my mind that MP, for sure (that's an understatement), and Ryles are walking into BK Court with unclean hands. However, I really do no think Ryles would have gone this far only to smell the coffee, now.
The most likely explanation for the withdrawal by his attorney - assuming that's true - is simply that the attorney was not getting paid and wasn't willing to see his unpaid tab being run up by what appeared to be a lengthy deposition and document review.
Another "off the wall" explanation, could be that Ryles or his attorney think this is going chapter 7 and that planned discovery proceedings would be a waste of time and effort - since neither Ryles and perhaps his attorney would receive a dime in Chapter 7. This explanation seems extremely unlikely in light of the pending motion to have the reorg Plan approved.
Re the proposed Reorg. Plan:
It is becoming quite clear that there is very little in the way of investor money committed or waiting on the sidelines or that significant revenues are just around the corner. The proposed Plan essentially satisfies creditors with stock and warrants and has the current shareholders having to take it once again on the chin in a 1 for 10 reverse stock split.
Perhaps I Missed Something:
I've never heard of a Judge vacating a deposition/discovery order based on the deponent's assertion (upon information and belief) that the attorney for the party seeking discovery was withdrawing.
I guess it's possible that the Court received notification from the withdrawing attorney or from Ryles confirming the withdrawal and it was just not made part of the record. But if that was the case, the motion papers and/or the Order to Vacate would have had a recitation to that effect.
At the very least the Court's Order should have been a postponement (not vacating) of the hearing pending the confirmation of the withdrawal and perhaps a reasonable time to retain new counsel to conduct the deposition.
I have to believe I'm missing something.

Could be. We will soon find out whether there are orders or potential orders and whether there are investors waiting in the wings.
The BK Judge and Trustee are specifically requesting this information. Further delays in disclosure or if there is disclosure but the numbers of orders or potential orders or the amount of investment money waiting in the wings is not sufficient, then conversion to Chapter 7 is likely.
But keep in mind that the BK Court will try to find a way to go the reorganization route so as to protect the interests of ALL creditors and the shareholders.

Having stated all of that, I am not sure if JB is not playing fast and loose withe the BK Court. He keeps insisting that he has investors waiting on the sidelines to support a reorganization plan, but he hasn't provided the evidence or particulars, to date. If he doesn't have a plan supported by adequate investing, a Chapter 7 is a given.

I think there are other pssibilities for the SEC involvement. I know for a fact that a number of shareholders haver placed the SEC on notice and sent them various documents, emails, etc.,as part of this BK proceeding, which more or less indicate that MP and others are not walking into BK Court with clean hands and that the current bleak financial situation was the result of the inept and fanatical manahement by MP and his henchmen.
No doubt in my mind that MP planned, pushed and took delight in the CDEX BK filing and that he wants to pick up the pieces if they have to go Chapter 7.
But I've noticed a lack of participation by MP or his atty, if he has one, in the BK proceeding. I attribute that to the SEC investigating him -hence his backing off.
Look...JB had a personal bankruptcy, which may draw the ire of this BK Trustee, but this certainly would not prompt SEC involvement. In addition, JB has not managed the Company long enough and can hardly be held responsible for CDEX's dire financial predicament.
It all goes back to MP and IMO that's the reason for SEC involvement.
And for those of you consiracy theorists who believe JB was in cahoots with MP since 2004 or somtime therafter, that's absurd.
Plain and simple, JB was the largest shareholder and JB saw his investment going down the drain and as the largest shareholder he was the leader in getting MP out and then took over management of the Company. If there was some hidden hook-up with MP he would not have had a chance in getting the present directors on the Board. None of them would have anything to do with MP.
There is simply nothing factual to give credence to the insistence by some that JB's and MP's interests are aligned; that they planned this latest scenario; or that JB would give that a-hole MP the time of day.

When I read the Court's statement I was baffled. CDEX WANTS to give the escrow monies back to BAXA! The Judge was basically telling CDEX that they were stupid. The Judge, rightly so,said that the escrow money could form part of a reorganization plan. He basically told CDEX that they may want to rethink their position.
Sounds like CDEX wants a Chapter 7. Their could be an MP/JB deal that JB will get free or cheap stock in a new Company.
I relly cannot think of a more fitting explanation. Of course, this is just a guess...but an educated guess based on past history.
As for the CDEX products. IMO, ValiMed or whatever they're calling it now, is possibly good saleable tech. The ID2 will never sell until there is a complete array of signatures.

Was watching "Lockdown" on MSNBC over the weekend . They were covering the prison meth problem at some midwest prison. It showed the guards using a drug detector and it sure as heck wasn't the ID2.
