I would think Swift would have to know of the conflict of interest and that ALL actions taken while he is in charge will be reviewed. I don't care if he is CEO, COO, or janitor. if he has authority to take the actions on behalf of the company, then he is the man.
getting our money back is one thing... but, I want to see someone go to jail!!!
Like most here I have been sorely depressed and angry on the recent PPS and activities (or lackthereof). However, as of this evening, I have reassessed and am now taking a bullish stance on XKEM.
Mind you, I don't know all of the legal issues going on. However, when I bought in earlier (average currently at $.024), I considered the value of the company based on potential and at full dilution. At that time, I still felt $.024 was a sound investment based on the potential.
with that said, I believe Swift and team will spend the next 3 months straightening things out, and ALSO continuing to increase sales and production. Come January, which is strong for pharma companies, I easily see this getting back into the $.02's - which is a 4X return on investment.
I have been wrong before - God only knows... but am working to add funds to start buying more at this level. I like the odds right now.

I personally appreciate your input. I might not like all you report, but that's not your fault or problem. Being informed, good and bad, is the only way we can make the best decisions, so again, appreciate all you bring to the board.
As long as someone goes to jail, then I'm ok with what will be reported from the company. Anything less will be unacceptable. Of course, that would mean the SEC would actually have to do something, so not holding hope - but it would be nice.

I absolutely see this as being a takeover opportunity for someone (Basu's group? Others?) at a measly $11M market cap - IF in fact the sales and production are way up, as previously rumored on this board.
Where it goes from there would be the big question. Remember, a lot can be "hidden" relative to poor management (bad books) during a merger or takeover, if the parties so desire. I have seen it many times in the past.
All speculation on my part, but if I was in a position of a Basu or other similar groups, I think I would be considering it.
The key questions one has to ask are:
1) Do you think the PPS will go up from here?
- if not, then sell, take the loss, mitigate any forward risk, and take it as a lesson learned.
- if so, then hold or add to your position. Even getting back to $.0125, which is way down from where most of us sit, (still just slightly above a $20M market cap) is a double from these prices.
2) If you do think the PPS will go up, do you think it will go up within 30 days? If you're a long and stuck (like myself), then the 30 days allows you to dump, take the tax loss, but still buy back at these prices...
the what-if's, why's and who's to blame is all good, but won't necessarily fix the problem many of us are in. As one of my best friends always tells me, "take the emotion out of the decision". What would you tell your friend, or mother, or father, or client to do if they were in your position???

Drift/BigD/others - i have been away from the boards for a while, but i cannot believe that what is happening here isn't orchestrated. I cannot believe Swift would come in, let this fall apart, miss the sec filing (even for an extension), and stay completely silent - without intention. why? i have no idea. I guess that's the multimillion $$ question that i hope we are all pleasantly surprised in when it comes to light.
Any thoughts or insights as to why?!?! and if this has already been discuss ad nauseum, i apologize.
So, the question that comes to mind is: "Why would Mr. English, who appears to be extremely seasoned and qualified, take an IR position that he's not allowed to perform any IR functions and communicate to shareholders."
If he leaves quickly, then he obviously doesn't agree with how they are tying his hands and will not be a good sign.
However, if he doesn't just move on, a more hopeful thought is that he understands the bigger picture, what's on the horizon, and the reason for the quiet period, and knows/expects it to be a short term "stall" before an explosion...
I can't believe someone with his experience would tolerate an idle position, so I have to believe there is something cooking.
Yes, I am an optimist and a stakeholder, so it's in my interest to want that to be the case. But logic also justified that position.

This is great, JoChef - thanks for posting. So, even if we stayed at pace for Q4'06 and Q1'07, we'd be on track for over 100% revenue growth for the year, compared to 2006. Of course, I don't expect revenue to stay flat for Q2-4 of this year, and am expecting 100's or 1000's percent revenue increase for the year, comparatively. The visual is great for seeing the turn from strictly R&D to true sales.

I would like to see 2 PR's this week. The first stating that the 3rd dryer is inline and operational, and that they have ramped up production to xx,xxx pills per day.
The 2nd PR I want is relative to distribution agreement(s) (possibly with the hospitals), ensuring consistent and continual delivery to more than x0,000 patients immediately.
Both seem to be practical from what I've heard. And, both would specifically equate to increased sales.
Of course, I wouldn't complain for a pre-purchase from ANY entity at ANY time too...
Just thinking/hoping out loud!! However, if Mr. English is reading, and these milestones have been met, please please scream them from the rooftops!!
Distribution is a key for ramping up sales. Moreso, consistancy in distribution will be one of the keys to success. At a retail level, they obviously don't have walgreens or CVS's on every other corner. However, I don't know why they can't effectively dispurse to the hospitals - which is quite a list: http://www.answers.com/topic/list-of-hospitals-in-nigeria
My guess is that these hospitals treat a large percentage of the SCD population and could provide a means for distribution. I would love to see the next PR highlighting such an agreement, while also quantifying the number of patients each will serve.

Having an opinion isn't insider trading. If someone starts spouting out specific KNOWN revenues prior to a filing, now that would be bad. But guessing at what the revenues or QTR will be is just part of the insanity of the market.
I have to agree with you Drift. ANY news showing revenues should excite the PPS. Loans, construction updates, distrib. agreements, etc are all critical to the success, and should have some affect on PPS, albeit probably short term. Revenues are key to us moving up and staying up. PPS priapism, so to speak

Drift, whether it's a material event and they are FORCED to file/PR it shouldn't be the question. They should be standing on roof tops screaming that they've got it secured the minute it is done. I don't understand the logic of being so silent, based on all of the going's on with this company.
It definitely goes to the points of many that they are trying to keep this down/quiet on purpose.

Its impossible to understand intent based on the filing - imo. If you're optimistic, you can look at it as bullish and a positive thing. If you're pessimistic, you can see it as a point of concern. Short answer though, it is what it is, and it was based on whatever decision criteria Steve chose to use... if he shares that info, then we will know the reality of the situation. beyond that, its pure speculation - IMO

Happy and thrilled? no, not quite. more of understanding of the situation, which is why we sit at $.022... these are the risks associated with start ups. If I thought it was out of line, I would have sold and moved on. Things don't always happen in the timeframes I would like, but they are happening. So, I CHOOSE to hang in there and add whenever possible, because I am confident they are still moving forward.
It's an easy investment decision either way, imo.

pics are outdated??? The construction pics are a month old. What are you expecting - new pics every day? Would be nice, but not practical and I would hope this small company is focusing on executing their business plan vs. updating pics daily.

Agree. I would not expect Basu or team to be trading based on insider info. that is illegal, and I think this group (from what I've been able to find) is a solid group of investors.
However, they have many friends in the investment community, and from what I have seen, friends of friends of friends often get insight to activities prior to the formal announcements. Again, its just my opinion, based on what I see in the markets. I don't expect ANY stakeholders here to jeopardize their position (or freedom) by doing anything illegal.
I hope you're right, but the volume doesn't support it. Based on having a new investor group even deeper in the "know", I would expect even more significant volume ahead of any PR's. Especially PR's with substance.

I agree with you Drift. Further, I think revenues/patients stay small (controlled), until I see some definitive distribution agreements PR'd. I know Bigdaddy has indicated some have been signed, but I am hoping to get the official from the company soon, if true.
Have you heard anything around any dist. agreements? Those, with the extra equipment will quickly take us to the 30K mark ($600K+ per month in sales).
just remember, they took us down to $.018 just prior to the NEXIM loan PR. I absolutely believe someone is pulling the pps strings right now, and playing this thing ever so well. Until the company announces quantifiable improvements relative to manufacturing, distribution, and ultimately sales, I think this will continue. They will take us up and down based on an agenda. Ultimate, the company will win because we are on our way - but its frustrating waiting for the paint to dry, so to speak.
Patience everyone.. or try and play along. However, there is huge risk in trying to play that game. Not many succeed.

Agreed - it really highlights turning the corner from being in an R&D phase vs. moving the business into a sales phase. A perfect time to be invested here, as a result.
$197K in revenues from the sale of Nicosan for the year; which would be around $120K for Q4 (just as Drift predicted).
Other than that, I don't see anything surprising. What are you seeing that doesn't look good?
I'm not quite sure what the heck you saying. An IPO by a subsidiary is an excellent way to increase value and overall worth to the company (both the parent company and the subsidiary). Nothing to date, that I have seen/heard, has indicated a spin off. However, I would be just as happy with that. If the company/business is sound, that's a flippin' gold mine!!!
So, anyone crying foul really needs to take a class in business. However, my guess is that those crying foul are practicing their own business and trying to create a false sense of panic to those that don't fully understand. Shame on you!

I agree with your recommendation on holding (maybe even adding a few here). I was concerned with the typical momo play, which would have me thinking about "trading" a few shares. However, the trading does not appear to be acting like a true momo (not yet at least). The buying pressure has been strong and steady, and the mm's are keeping it controlled. so, it sounds like a "smart" buyer, and one with deep pockets, rather than the irrational exuberence of a momo.
Which leads me to believe there are good-things-a-comin'

Agree Trazbull. If you look closely at ANY big run, there are so many little dips along the way to fool investors, create panic, make flippers think it's the top, etc... I am very optimistic that this is just that. When you look at the chart in a month or so, many will be saying, "Man, I wish I got in at .025 or .03... or even .05"... and so on.
BigD - the "investor" private placement you speak of sounds fairly substantial. Any details you can share?
