Republic Wireless just went live with its beta program on Nov 9, and the traffic to the site was so heavy that it went down for a period of time that day. There are some caveats at the moment, such as only one smartphone model available initially, but if Republic can get this worked out it may represent an opening of the floodgates to the long awaited wifi smartphones...

The Complaint attaches letters to Calypso - says they contacted Turrini who told them to contact Williams in December 2010. They are at least aware of this issue/lawsuit and hopefully are handling. All I know is what I read.

It's a "message" filing. It says if you want to litigate, we have dozens of witnesses, this case is not going to trial any time soon, and and your going to spend a fortune lititaging against us. More than they needed to say in a normal supplemental filing. Could be posturing for better terms in a settlement?

Also- The court docket is CM/ECF - electronic docketing. When something is filed electronically by either party (mandatory) it is docketed instanteously in real time.
You will likely see a joint motion to continue or lift stay or a notice of settlement but who really knows. Maybe a request for status conference. Patience.
Wednesday, December 22, 2010 is the last day of the stay. If they want to continue the stay they would have to file something by then. If not, they technically don't need to file anything but likely would file some sort of notice.

Everytime I check in to this forum I see speculation and misinformation posted as fact - thank God I only look in once a week or so...
The Order to Mediation was and order requiring the parties to schedule mediation not complete it. The Motion to Disqualify was to both Williamson and Rusnak. Unless your day trading why not just sit back and wait for real information. The stock is either going to tank or skyrocket - read as zero or $5-7.
I think ya'll are right there won't be many more signals until the deal is done - I'm thinkin global settlement (fed/state) and T-Mobile buyout offer - you pick the number but it will be dollars not cents...

Plaintiffs Calypso Wireless, Inc., Drago Daic, and Jimmy Williamson, P.C. (collectively, “Plaintiffs”), , by and through their respective attorneys, respectfully submit this request for an extension of seven days from September 23, 2010, to September 30, 2010, to file Plaintiffs’ Opening Claim Construction Brief pursuant to Local Patent Rule 4-5(a), showing the Court as follows:
1. Pursuant to the March 9, 2010 Docket Control Order (Dkt. No. 132), the Plaintiffs’ Opening Claim Construction Brief pursuant to Local Patent Rule 4-5(a) is due on Thursday September 23, 2010.
2. Plaintiffs have been diligently working toward preparing their opening brief. However, their time for completion was shortened by the continuing efforts of the parties to narrow the issues for claim construction. In addition, it is understood that principals from T-Mobile and Calypso have been engaged in settlement talks and counsel for the parties have been exploring the possibility of staying the case to continue those settlement talks.
3. This extension is not sought for delay, but to further narrow the issues for trial (and that require the Court’s involvement).
