The Federal Circuit Has a Soft Spot for T-Mobile’s Hot Spots
http://www.ipbrief.net/2014/02/14/the-federal-circuit-has-a-soft-spot-for-t-mobiles-hot-spots/
Judgment Affirmed. Sorry guys. I'll post when I get to my office.
Oral argument is the place where appeals are won or lost. 15 minutes each side. Judges that are leaning against you ask hard questions and judges that are leaning toward you lob softballs. Wrong answers to either are deadly. Appellees generally don't get rebuttal. The Appellant gets to split his argument - open and close - that is why T-Mobile's time is listed as undecided.
Fed Circuit Docket Text:
Appellants Calypso Wireless, Inc., Drago Daic and Jimmy Williamson, P.C. designating Matthew C. Juren as arguing attorney. Designated time for argument: 10 minutes. Designated time for rebuttal: 5 minutes.
Appellee T-Mobile USA, Inc. designating Josh A. Krevitt as arguing attorney. Designated time for argument: undecided. Designated time for rebuttal: undecided.
Fed Circuit Filings: Oral Argument Scheduled
Case scheduled Feb 03, 2014 10:00 a.m. at the United States Court of Appeals for the Federal Circuit (Howard T. Markey National Courts Building, 717 Madison Place, N.W. Washington, DC 20439), Courtroom 203.

Housekeeping. T-Mobile had several requests for relief - I don't remember off hand what they were - maybe patent invalidation, etc. (order of non-infringement was the principle request) but all claims need to be resolved for entry of final judgment, and as a prerequisite to an appeal, if any.

Condition Precedent to filing an appeal...
Not automatic. Need a Final Judgment of Non-Infringement and then a potential appeal to the Federal Circuit.
