It says to me that the Calypso parties are broke and want mitigate litigation costs - which is no surprise. Also, though, that T-Mobile's attorneys are on a budget for agreeing to this. Expert testimony is the backbone of patent litigation. We'll see...

Has anyone looked at the Delaware case docket recently? Receivers are supposed to post status reports with the Court every 3 months. It's been 3 months.

There will be a hearing/trial on February 1, 2012. Calypso does appear to be participating. I would caution against arm-chair quarterbacking conclusions here. These are all complicated legal issues, either side could prevail and neither seems entirely blameless.
I don't want to speculate. I'll try to get a copy of the Complaint in the next day or two and post it.
Yes - but you need to login to a terminal at a Delaware Courthouse. Don't use LexisNexis, they charge $20 for every inquiry or document. I have a friend who is a process server in Delaware who stops by the Courthouse a couple of times a week and can access. There was a telephone conference on Thusday I believe to schedule an expedited hearing but there wasn't any indication in the docket yet that this had been accomplished or even that Calypso had been served.
Delaware lawsuit:
There is a lawsuit in Delaware to overturn the removal of DHW and appointment of Carlos Di Colloredo-Mels. It was filed in the New Castle Court of Chancery on December 23, 2011 - Case No.: 7140-VCL. The complaint and claims are essentially the same as those raised in William's LA County Court cross petition - which was denied. I have very limited access to the docket and documents but will try to follow and report progress.
Settlement:
My understanding is that the material terms of the settlement agreement must, at a minimum, be filed with the U.S. Securities and Exchange Commission as a part of the 3rd or 4th quarter 10Q unless an application under Rule 24b-2 requesting confidential treatment is filed and granted - both of which seem unlikely. HOWEVER, given that Calypso has not filed a 10Q in more than 3 years, we could see the settlement as an 8K (I don't think the prior 8K announcement was sufficient) or we may not see this until the SEC filings are properly updated.
Why doesn't someone just ask Cristian to release a copy??

and BTW - this is the way that settled cases end - with a joint stip or agreed order of dismissal with prejudice. You don't need to file the settlement. The key terms have already been announced. The Settlement will likely be filed with SEC soon enough.
Diac's counterclaim was his claim to the patent. It will be dismissed with prejudice under this filing.
