Let's all see if the words "still believe" are real, or if they're empty just like the bank account of a penniless scammer hiding in his mommy's basement.

This is a very easy bet for someone who claims to know the executives inside the company, their thinking, and the timing of how they do things.

Start with how do you value a company that hasn't reported its balance sheet in over five years...
The legal system cannot force spouses to testify against one another. In a sense they're treated as one person.
But when this goes to trial and there are third party witnesses testifying that changes everything. Basically opens the door to fresh charges against CEO #1 even if Mark Schena says nothing.

I'm waiting to read about a few more guilty pleas from others associated with the $ARYC scams between now and the trial date. Sone inside ArrayIT and some counterparties who accepted bribes.

If Mark Schena is found to be lying to the court they will add perjury to the charges. Now there are two named witnesses he will need to think long and hard about whether he wants to face a jury.
This is the angle Rene Schena will end up facing prosecution from.
The prosecution cannot force a spouse to testify against their spouse, but the witnesses will attest to Rene's roles in the scams.
This is my view, mostly. However I feel $ARYC was cruising for criminal charges because of their continual lies.
Definitely not. In fact the closer to the trial date, the worse any offers are that remain on the table. The time to have cut a good deal was months ago.
The prosecution and defense lawyers both talk with each other as witness statements, etc. are shuffled between both sides. Schena by now has certainly seen for himself what the prosecution is specifically alleging and like is close to / has already completed his responses.
I would guess that between the two legal teams there's already an understanding of the level of sentence Mark Schena is likely to receive. I would guess Pickles has informed Schena of this, but he probably is still in a state of denial.
Since no financials have been filed by $ARYC, the SEC will point to that specifically as part of the package of fraud and misleading investors by making both false statements and $ARYC not fulfilling their obligations as a then-SEC mandatory filer. I doubt ArrayIT files any financials as part of this trial, or ever since it would be even more incriminating than having nothing. So on that basis the "window into the last five years" will only come about from statements made in a court of law should this go to trial.
$ARYC was not a Quiet Period after the 15-12B was filed on 08/19/2019, and it wasn't a Quiet Period before then either as evidenced in both instances by the tweets, communications with shareholders, information updates on the website, etc. If Pickles raises the Quiet Period claim, the SEC/DOJ team will simply point out that the company in fact continued communicating with the investor community, thus was not in a Quiet Period.
The DOJ side of the case is even more clear cut. There are many prosecutions for Medicare fraud, and the DOJ legal team has practice preparing the fact package and prosecuting these types of cases.
$ARYC is probably on the verge of bankruptcy right now. Everyone will know based on their ability to settle with the university.
I feel the SEC and FINRA failed investors, and the brokerages decided to take action. Its a difference of opinion.
Someone was telling me on Twitter that E*Trade held the largest OTC holdings because they allowed trading in STOP and CE tickers.
Brokers like Fidelity, Schwab, and a bunch of others already had restrictions in place. So the market has shrunk dramatically.
This is brokerages protecting retail clients from fraud. Its better than regulatory action from the SEC or FINRA. There's no work around.
Today was the last day for E*Trade account holders to buy more $AYRC, or transfer or deposit $ARYC into their accounts.
With so many brokers no longer allowing the purchase of Caveat Emptor stocks, there's at best only a very limited "Expert" market. So much easier for the SEC to identify bad actors on the trading side of the market.

Its entirely possible. Also at some point ArrayIT could also become a co-conspirator. Corporations are living entities and can be sued.
There are assets hidden somewhere. Bank accounts which received stolen money from Medicare and insurance companies, and later effected outbound transfers.
Small amounts of cash (few thousand dollars) can be withdrawn and moved outside of the formal financial system, but not tens of millions of dollars.
I hope the DOJ and SEC subpoena the banks and financial institutions $ARYC was counterparty to. Follow the money.
This is a nice example because it mentions co-conspirators, just like the prosecutors mentioned in the Schena / $ARYC case.
The main point though is there are lots of examples of criminals like Mark Schena receiving prison sentences for Medicare fraud schemes.
Lots of people who commit Medicare fraud gets jail time. These are some random ones I found with only a brief search. None of them was even close to $69 million in fraud.
If the dollar amounts involved are a crude measure, Mark Schena will get a longer sentence than these cases, which is what the government prosecutors outlined in the hearing. Years, not months.

I doubt Nielsen ran the stock selling scheme by himself. He needed outside interest to buy $ARYC stock from him / sell back to him as the price fell.
That but itself doesn't make Nielsen a co-conspirator, which is why I guessed charges against Rene may be coming. In any event it's the first use of the word "co-defendant" I've heard used with respect to $ARYC and Schena.
If it's purely a DOJ comment, the co-defendant could be Julie Taguchi from the Medicare fraud angle.
