Information, explanations, etc., about both companies has been posted more times than I can count. This has been done by people a that know a lot more than I do. If they couldn't get through to those that still don't understand, there is no sense in me trying. I don't have as much patience as Chuck!!

I want to make if very, very clear that when you say "and not one of us would have bought a share if we didn't think...." you are not speaking for me in any way, shape or form!
While I agree things are taking much longer than we all hoped, I entered into this with my eyes wide open! I purchased a fairly large number of shares before the bankruptcy, I have purchased the rights to some new shares of CPRK after the BK was filed and I have purchased shares of ESF all the while knowing there are no guarantees!
Anyone that invests in stocks, especially BK stocks should know this type of investment is at best, a very long shot. If you didn't understand that, you probably shouldn't have invested in this in the first place! If you bought shares before BK you should be happy that you have a chance of this still being a good investment. What many of you seem to forget is that most of the time when a company enters BK, the shareholders lose EVERYTHING!! Whether you think it's a good chance or not, at least CPRK shareholders have a CHANCE of being able to make money on their investment.
I spoke with Lee not too long ago and can assure you that he is just as frustrated as any of us that we aren't trading yet. He truly believed we would be trading by now. Every day we don't trade costs him money!! As I believe has been mentioned on here before, Lee has more money tied up in CPRK than most of us combined! For those that keep repeating the same mantra about Lee lying I will say this.....never mind, you are worth my time....
FYI....Chuck is not on the CPRK board. He isn't getting paid a plug nickel! Chuck doesn't have to take the time to answer the same questions a dozen or more times. Chuck doesn't have to offer to speak with people 1 on 1 in an effort to help them gain a better understanding of what is going on with CPRK. Chuck does this because he wants to see this company make history by coming back to life...and of course like all of us, he wants to make money too!! Frankly, I don't know why he puts up with the BS a few people on here throw his way!!
One final comment. CPRK and ESF are two separate companies. CPRK is a mining company. ESF is an investment company that loaned CPRK the money to get out of bankruptcy.
Do you know who the current board members are? Have you ever met or spoken with any of them? Do you have PROOF that Nethers is involved today?
I suspect the answer to all of the above is no......surprise me....

As a follow up to my previous post here is the response I received from TD Waterhouse,-about the only broker trading CPRK - (Canadian arm of TDA) concerning my question about people in the US using their service::
"We appreciate that you would like to open a TD Waterhouse account in Canada as a U.S. resident. We'd be happy to respond to your question.
Based on your question, a TD Waterhouse representative is in the best position to address your inquiry. We would recommend that you call TD Waterhouse directly at 1-800-465-5463 or 416-982-7686. A representative would be happy assist. This department does not accept specific account enquiries through secured email. We apologize for any inconvenience."
I haven't had a chance to call them yet. If someone does contact them let us know what you find out.

eddie....I sent an email to TDWaterhouse (Canada's version of TDA) about this very topic. I will let you know when I hear back from them.
Hopefully someone else already knows. I hope we can open accounts up there....at these prices I want MORE!!!
A couple of thoughts.
First of all Stang......I too am curious what the charts say about this kind of gain? I have heard all kinds of predictions but nothing has been said about nearly doubling the share price.
My second thought.....I would like to thank CHUCK/ESHC and BOD for making the share price rise like it did today. Since they seem to get the blame when the price is down I think it is only fitting to give the a round of applause, a pat on the back and a great big THANKS!!! Good work guys. Very few people can make a stock nearly double in one day!!
I see good things on the horizon for CPRK.......TIC TOC, TIC TOC!!

There are numerous court documents describing the deal, with more to come along with a POR, as it stands now the ESHC is going to have to pay around $100,000.00 more for attorneys fee's out of their pockets on behalf of all the shareholders, any accusations of them "selling out" are ludicrous.
What part of Chuck not being on the BOD isn't clear. The BOD is who would decide things like splits, etc.....NOT the ESHC! Not that it seems to matter but......you are asking the wrong person!!
I'm with you Satellite. The train may be taking a different track then we expected but there are many tracks that can lead us to success!
Satellite.....I am in for the duration. I voted for this BOD because I was and still am confident they will do what is best for everyone.

Ok.......and......
I'm not trying to be argumentative or a pain but.....
I still don't see where it says a POR can't be presented.... In fact it says "The offer is subject to overbid at the hearing on the Motion."
Sorry.....but I disagree with your interpretation.
I have read Doc 777 several times and no where in it do I see anything that says a POR can't or won't be presented. In fact, I don't see any mention of a POR period.
Copper.....I don't know if I would say the Unsecured Creditors "like" the offer Skye has put on the table. In my opinion they have agreed because so far they have not been offered anything better so they figure getting some of their money is better than none at all.
What we have to hope for is that the ESHC and our new BOD can come up with a plan that will offer them a bit more!!

As I understand it the "unsecured credit holders" have agreed to the APA as well. That doesn't mean that if they get a better offer they wouldn't change their mind!!

Just because they (the dark side) say something doesn't make it accurate. Think about what has transpired this week. Didn't the ESHC ask the court to delay the deadline for objections to the APA???? Why would they do that if they had "agreed" to it???? I don't think they would have............

They are in the middle of dealing with court proceedings that will eventually decide whether we make some money or lose it all. For the BOD to say anything other than "Hi, thanks for voting us it" could be giving the opposition information best held close to the vest or it could be considered insider information.
Please don't misunderstand me...I completely understand the feelings of those that don't feel comfortable putting up money for the cause. My only concern is that you maybe wishing for something that just can't happen right now. If that is the case then you may be cutting your nose off to spite your face. Don't get me wrong, I would love for the BOD to come out and tell us exactly what they are up to. Unfortunately in our current situation I believe they have to be extremely careful with what they say!
We elected this board because we trusted them to do their best for us, the shareholders. My opinion of them hasn't changed!

It's all a part of the "Golden Rule." Those that have the gold make the rules. Don't you know that the price larger shareholders can sell their stock at is higher than the lowly small shareholders? LOL!! As a double bonus they get to pay less for it as well!!
I guess I don't own enough shares yet because mine are only worth what they are listed for on the exchange!! Guess I need to buy more to get those favorable rates!!

I transferred my shares from Scottrade to Fidelity with no real issues. I opened my account online THEN I did an "asset transfer" of just my CPRK stock. I had to print, sign and mail some paperwork to Fidelity before the transfer could take place.
One last thing you want to be sure and do.....call Fidelity (after your account is set up), speak to a broker and tell him/her you want to be able to trade penny stocks. No need to mention what stock....keep it generic. The broker will read you some stuff about trading pennies/pinks. Once you verbally agree he will have a Sr. Broker update your account.
The entire process took me about a week. Be patient!

Trueblue.....the hearing for the sale is on 8/22/11. Motions against the sale have to be filed by 8/1/11.....assuming I am reading things correctly.

I seriously doubt Chuck or our new BOD can or will comment on what may or may not be a part of the POR.
If I have read the documents correctly (50-50 chance) the money will be used to make the lease payments and pay the bond and insurance fees. There may be some other operational uses as well.
I don't mean to speak for Chuck but.......on more than one occasion he has said that he is not going to guess when things are going to happen. He has however, said the SEC is a priority!
All guessing does is set him and/or our new BOD up in a no win situation. If they tell you the SEC thing will be cleared up by the end of the week then the SEC decides they want more information people, (not necessarily you) will start hollering that we can't trust him/them. In addition, I have little doubt that JB, the old BOD and/or skye are looking for ways to get back in the game. I suspect the last thing Chuck or our BOD wants to do is to tip their hand.
I completely understand wanting to know what is going on and when as I too have a fairly large stake in this company. BUT......we elected the new board because we trusted them and the people that recommended them (ESHC)so let's give them a chance to do their magic. I have absolutely no doubt they will tell us what they can, when they can.
As hard as it is going to be we need to have patience, patience and more patience!!

There are those on this board that have admitted to pumping the stock for personal gain in the past. One could easily assume those same people are now taking a negative stance for similar reasons.
It doesn't take long reading this board to see who bases their opinions on facts versus making statements for the sake of hearing themselves speak. The people who have been around for a while know who the pointless pumpers and naysayers are and know to discount what they say. For the new people, do your own DD before putting stock into what anyone says on message boards.
There are tons of FACTS about CPRK's current status for those that want to take time to search for them.
The FACTS are that due to the efforts of the ESHC the potential outcome for the company and especially the shareholders is bright. Yes there is still a long ways to go. Yes things could still go wrong BUT we are in a much better position to be successful than we were this time last year!
As for the people that continually pop off without anything to back up their statements.....ignore them, they will eventually go away.

I am by no means an expert on these things but my understanding is that the new board (assuming everyone VOTES)can/will give JB the boot.
I am also pretty sure there is a 90-day waiting period once a POR is presented before it can be "approved." This waiting period would give the NEW BOARD plenty of time to toss JB's POR (we know it won't be in our best interests)and hopefully replace it with one that we can all be happy with!
