Buyers ‘Tricked’ at Priceline, Orbitz, Other Sites, Senate Says

Nov. 17 (Bloomberg) -- Priceline.com, Orbitz.com and
Comcast Corp.’s Fandango are among 19 retailers that each made
more than $10 million from partnerships with Web companies that
“trick” shoppers into online purchases, a Senate report said.
Affinion Group Inc., Webloyalty and Vertrue Inc., all based
in Norwalk, Connecticut, “have earned over $1.4 billion in
revenue by using aggressive tactics to charge Internet shoppers
for club membership programs,” the U.S. Senate Commerce
Committee said in a report released today.
More than 450 electronic-commerce Web sites and retailers
have earned a total of $792 million from their partnerships with
the three companies, according to the report. Affinion, Vertrue
and Webloyalty charged customers for services they didn’t use
and were unaware they had purchased, and partners “know that
their customers are being harmed,” the panel said.
“Millions of Americans are getting hit with these mystery
charges every month,” said Senator Jay Rockefeller, the West
Virginia Democrat who is chairman of the Commerce Committee.
“The companies we are investigating have figured out very
clever ways to manipulate consumers’ buying habits so they can
make a quick buck.”
In exchange for “bounties” and other payments, online
retailers agree to let the three companies sell memberships in
clubs offering travel, dining, shopping and other services to
consumers as they are buying goods such as movie tickets,
electronics and plane tickets, the panel said in the report.
The Web sites and retailers that have partnered with
Affinion, Webloyalty and Vertrue include some of the most well-
known and high-traffic sites on the Internet, the panel said.
Companies Respond
Priceline believes Affinion’s offering to its customers
“has been clearly and fully explained on the Web site,” Brian
Ek, a spokesman for the Norwalk, Connecticut-based company, said
in an interview.
A spokeswoman for Chicago-based Orbitz Worldwide Inc.,
Marita Hudson Thomas, didn’t immediately return a telephone
call. Harry Medved, a spokesman for the Fandango unit of
Philadelphia-based Comcast, had no immediate comment.
Vertrue, which markets services under the indirect
subsidiary Adaptive Marketing LLC, said in an e-mailed statement
that it is “strengthening” its practices to provide consumers
with “clear, conspicuous and repeated disclosure” of all
terms. The e-mail didn’t attribute the statement to any
executive.
James Hart, a senior vice president for Affinion, said in
an e-mailed statement that the company has “always complied
with the highest standards.”
“Nearly all of the Webloyalty practices described in the
report no longer reflect the way we do business,” Beth
Kitchener, a spokeswoman, said in an interview. She said the
company had “made changes over the years.”
Sales Offers
During online sessions, Affinion, Vertrue and Webloyalty
insert sales offers after consumers have made a purchase and
before sales confirmation is complete, the Senate panel said in
the report.
“Misleading ‘yes’ and ‘no’ buttons cause consumers to
reasonably think they are completing the original transaction,
rather than entering into a new, ongoing financial
relationship,” the committee said.
Since 1999, Internet consumers have been enrolled more than
35 million times in Affinion, Vertrue, and Webloyalty’s
membership clubs, the committee said in the report. It listed
examples of consumers unwittingly enrolling to pay $10 and
$14.95 monthly.
Consumer Expectations
Affinion, Vertrue and Webloyalty “exploit consumers’
expectations about online shopping to trick them into joining
their membership clubs,” and share the revenue with Web sites
and online retailers, the panel said in a news release.
“Consumers often do not know these companies have their credit
card numbers until they start seeing charges on their bank
statements.”
Classmates.com, a unit of United Online Inc., has earned
more than $70 million “using these controversial practices,”
the panel said. A telephone message left for Mark Goldston,
chief executive officer of Woodland Hills, California-based
United Online, wasn’t immediately returned.
Vertrue was de-listed and bought in 2007 for $800 million
by private equity investors led by One Equity Partners, an arm
of JPMorgan Chase & Co., according to the Senate report.

Honestly.. that was a horrible PR. in all honesty, what he should've said is something about why they are late in launching. I would've felt more comfortable with an explanation about saying launching on Oct 2, and not realizing it.
We need some more details, rather than it is focusing in on the travel market.
