I agree with you, but my opinion holds little value. It would take me some time to dig up, but I remember coming across at least two recent cases shared here where the “unfavorable panel” came to a “favorable” decision.
I don’t like playing the odds game because each and every case stands on its own, but from what my layman brain can gather, it seems like we should have a shot with even the most undesirable panel.

The OA were highly unlikely to be scheduled for August 6 or 7.
"The Clerk’s Office will issue a Notice of Oral Argument once a case has been scheduled for oral argument. The notice is typically issued six weeks before the scheduled court session."
We’re looking at early-mid September as the earliest possible date.
If its related to an update in PACER, my best hopeful guess would be something to do with a settlement ?

I’m beginning to believe the panel may not matter as well. I am having a hard time understanding how Du’s handling of secondary considerations will be viewed as harmless despite not being supported by prior case law. If anyone can school me on this, i am all ears...
