Jairo Giraldo, pro se, petitions for review of the final order of the Board of

Immigration Appeals (“BIA”), which adopted and affirmed the Immigration
Judge’s (“IJ”) denial of his application for asylum, withholding of removal under
the Immigration and Nationality Act (“INA”), and relief under the United Nations
Convention Against Torture (“CAT”). After review, we dismiss in part and deny
in part Giraldo’s petition.
I. BACKGROUND
On April 19, 2003, Giraldo, a native and citizen of Colombia, was caught at
Miami International Airport trying to enter the United States using an altered
passport. While detained at Krome SPC, Giraldo sought asylum, claiming he was
persecuted by paramilitary guerrillas in Colombia because he refused to cooperate
with them. During his credible fear interview, Giraldo admitted that he had pled
guilty to bank theft in Colombia and had served 21 months of a 42-month sentence.
The immigration officer found that Giraldo presented a credible fear of persecution
based on political opinion. However, the officer also noted that Giraldo’s bank
theft conviction posed a possible bar to asylum or withholding of removal.
On April 28, 2003, the Department of Homeland Security (“DHS”) issued a
notice to appear (“NTA”) charging Giraldo with removability for using a
fraudulent visa and passport to enter the United States, in violation of INA §
212(a)(6)(C)(i), 8 U.S.C. § 1182(a)(6)(C)(i), and entering without a valid visa or
passport, in violation of INA § 212(a)(7)(A)(i)(I), 8 U.S.C. § 1182(a)(7)(A)(i)(I).

On October 29, 2004, Giraldo filed an application for asylum, withholding of
removal and CAT relief based on the same facts presented during his credible fear
interview. At his initial removal hearing, Giraldo admitted the allegations in the
NTA and conceded removability.
At his asylum hearing, Giraldo testified that FARC guerrillas had threatened
to kill him because he had refused to cooperate with them. Giraldo also testified
about the details of his criminal conviction in Colombia. Giraldo explained that he
had been a bank manager and had violated administrative banking rules by
extending credit to wealthy inviduals without being able to collect on the credit.
On the advice of his attorney, Giraldo pled guilty and received a 42-month
sentence. After 20 months, he was released for good behavior.
The IJ concluded that Giraldo was ineligble for asylum, pursuant to INA §
101(a)(43)(M), 8 U.S.C. § 1101(a)(43)(M), because he had been convicted of an
aggravated felony. The IJ also found, pursuant to INA § 208(b)(2)(A)(iii), 8
U.S.C. § 1158(b)(2)(A)(iii), that Giraldo had committed a serious nonpolitical
crime outside the United States prior to his arrival, which could bar Giraldo from
applying for withholding of removal. With regard to the merits of Giraldo’s claims
of political persecution, the IJ found that Giraldo had failed to establish past
persecution or a clear probability of future persecution. The IJ concluded that
Giraldo was statutorily ineligible for asylum, withholding of removal and CAT

relief and ordered Giraldo removed to Columbia.
Giraldo appealed to the BIA, arguing that the FARC’s escalating threats
against him constituted political persecution entitling him to asylum and
withholding of removal.1 The BIA adopted and affirmed the IJ’s decision in a
brief, single-member decision. The BIA concluded that Giraldo was ineligible for
asylum because of his aggravated felony conviction. In addition, the BIA found
that Giraldo had not met his burden to show that he was a victim of past
persecution, faced a clear probability of future persecution or would likely be
tortured if returned to Colombia. The BIA found the threats Giraldo faced were
not so “menacing or immediate” as to constitute persecution. Giraldo filed this
petition for review.
II. DISCUSSION
Giraldo’s petition asserts that the IJ and BIA erred in denying him asylum
and withholding of removal. However, we do not have appellate jurisdiction to
review these claims.
Pursuant to INA § 242, we do not have jurisdiction to review a final removal
order against a petitioner who has committed an offense covered in INA § 212, 8
U.S.C. § 1182, which includes a crime involving moral turpitude. INA

§ 1182(a)(2)(A)(i)(I). The INA does not define the term “moral turpitude.”
Vuksanovic v. U.S. Att’y Gen., 439 F.3d 1308, 1311 (11th Cir. 2006). Generally,
a crime involving dishonesty or a false statement is one involving moral turpitude.
Itani v. Ashcroft, 298 F.3d 1213, 1215 (11th Cir. 2002).
Giraldo was convicted of bank theft, a crime that required him to engage in
fraud, deceit and dishonesty. In light of these characteristics, we conclude that
Giraldo was convicted of a crime involving moral turpitude. Accordingly, we lack
jurisdiction to review Giraldo’s challenge to the denial of his application for
asylum and withholding of removal.
Although we do not have jurisdiction to review the determination that
Giraldo was ineligible for asylum or withholding of removal, we retain jurisdiction
to review constitutional claims or questions of law raised in Giraldo’s petition for
review. See INA § 242(a)(2)(D), 8 U.S.C. § 1252(a)(2)(D).2 Giraldo raises one
constitutional claim – that the BIA’s summary affirmance of the IJ’s decision
violated his due process rights.3

pursuant to 8 C.F.R. § 1003.1(e)(4), which approves the result reached by the IJ, but does not
necessarily approve the IJ’s reasoning. Instead, the BIA’s order was a short decision on the
merits of Giraldo’s claims pursuant to 8 C.F.R. § 1003.1(e)(5).

A short BIA order affirming an IJ’s determination does not preclude
meaningful review such that due process rights are violated “because an appellate
court ‘will continue to have the IJ’s decision and the record upon which it is based
available for review.’” Mendoza v. U.S. Att’y Gen., 327 F.3d 1283, 1288-89 (11th
Cir. 2003) (addressing summary affirmance under 8 C.F.R. § 3.1(a)(7)(iii), now
codified at 8 C.F.R. § 1003.1(e)(4)) (quoting in part Albathani v. INS, 318 F.3d
365, 378 (1st Cir. 2003));4 see also Prado-Gonzalez v. INS, 75 F.3d 631, 632 (11th
Cir. 1996) (addressing BIA’s decision adopting IJ’s reasoning for denial of
suspension of deportation).
Here, the BIA did not violate Giraldo’s due process rights when it affirmed
the IJ’s order in a short decision. The BIA’s one-paragraph decision adopted and
affirmed the IJ’s determination that Giraldo was ineligible for asylum due to his
past conviction. The BIA’s decision also noted that the record supported the IJ’s
determination that Giraldo had failed to meet his burden to show that he was a
victim of past persecution, faced the clear probability of future persecution or that
it is likely that he would be tortured if returned to Colombia. We have the IJ’s

decision and the complete administrative record to review. Furthermore, Giraldo
has presented no evidence that the BIA Board member failed to conduct a
sufficient review of Giraldo’s case before affirming. Thus, Giraldo’s due process
argument lacks merit.
For these reasons, Giraldo’s petition for review is dismissed as to his asylum
and withholding of removal claims and denied as to his due process claim.

The financial system is coming apart at the seams of OTC derivatives where there is no practical way to repair it.
An accounting regulation requiring truth is the last thing on earth that the pack of heathen liars of the Wall Street Temple Money Changers can handle. Tell the truth and the entire financial community is busted, period!
If you really valued $400 trillion "Type 3 Assets" plus of the OTC derivatives at what they are truly worth the world would end that day, so they will not. Even getting somewhat nearer to it is intolerable.
I would suggest that this is NOT the best time to buy the US dollar, sell your Cando, Euro and Swiss, sell your Gold or open a nice account at your favorite online one stop financial shop.
Maybe, just maybe, today is one more example of why you need gold. The entire investment world from shares to currency has been turned into a pure casino. Black boxes step over black boxes. Everything is manipulated or at least they try.

It is all in the US dollar. The second the dollar turns down from this little tiny rally gold will top $850, go past $887.50 and on to and through $1050.
Batten down the hatches and continue to work towards financial safety before anything else. All the halls of financial ivy are busted if the accounting rule taking effect November 15th is enforced.

Hello Bibiche I think Spellbound is correct before we get anywhere near the zero point we have a long hard road ahead. We will have wars like never seen before in the West. We have to have wars as someone wants the oil that is available. Right now China is in the Tar Sands making contracts for the next 100 years, they do not make plans for 5 years.
We have a scientist in Canada who said in 1995 (or close) that if China’s population change their life style by eating one egg per week that would drive us into WW3. Hello Spellbound, I think this is just a step away; America is not in a good shape at all. Britain took the same road that America is on today and the people of Britain suffered for decades and so will the American people. The rich and famous will not suffer as much as the working class. I have noticed that in North America there seems to be a problem with what is actually middle class. There is 5 different things you need to be actually middle class and most people do not have the protocol required but they just believe that they are not working class. There are a lot of people who have convinced themselves that they are not working class and they too will be in for a real shock.

Hello Trader, I know without a doubt that you have been badly abused on this board. I have always thought you where treated unfairly. I will say in my defense and you may add to this post if you would like; but many people on this board I have deleted similar messages for one sole reason this is a public message board and I know that people have been taken to court and sued. I have deleted many posts and contacted the authors of the post and recommended to them that they allow the deleted posts to remain deleted for their own safety.
You will remember better than I will but if I did not send you a similar pm than I must ask you to forgive me. If I did not do such my intentions where to do so as I have done such with many posters only for their own protection.
I have nothing to gain or loose, but the author of such posts has a lot to loose. I believe the last settlement in court awarded for damages $2million. I certainly would not like anyone on this board to suffer such just because they got a little hot under the collar because they can prove something but this is not the place to use as a forum there are other avenues that can be taken with such information.
I have saw people on this board make statement that would cost them dearly in the future if those comments where not removed. As soon as I see such a comment I delete immediately and then send a pm to the author and possible I was disturbed and neglected to inform you. I can only say it was done with your best interest at heart.

Hello Bibiche, Over 100 million years ago was the Albian Boreal Sea these ancient sands are hundreds of feet deep. You cannot bring this oil to the surface with water and salt. It is a very complex procedure; this is an open faced pit mine.

Hello Pep, I was going to go to Toronto and request a meeting with Ken lamb. At that time I asked if any of the members wished to accompany me on this trip. Chevy said that he and his wife would go with me and one other member off the board.
I asked a relative to go into Toronto for me and take a look at the office and I was told that it was just one secretary and there where hundreds of companies using this one secretary. I was extremely concerned with this information and I informed the board immediately and I think I may have been told something like take some meds and that I was not to concern myself with the office nor with Ken as he was good guy or such like!! Basically I was over reacting to the set up.
Ken Lamb phoned me up shortly after this and said that he was willing to have an unofficial conversation with a few shareholders on the phone to save everyone a long trip.
At that point in time someone brought it to my attention that the other person who had volunteered to go to Toronto was a non shareholder. I asked this person if this information that was given to me was true and he admitted such.
After this happened I went back to the board and asked for more volunteers and Lizard came forward and at the same time Kermit’s said he would like to volunteer for the call.
So yes there were a few people willing to make the trip and it was made known to the board that the Toronto office was not an office at all.

Beneath the frozen tundra of Alberta lies the Canadian oil sands the biggest known reserve of oil in the world. An estimated 1.7 to 2.5 trillion barrels of oil are trapped in a complex mixture of sand, water and clay. To put this in perspective, Saudi Arabia has “only” 261.9 billion barrels of proven reserves.
Since the Oil is frozen in the ground, extracting it is harder and more expensive than conventional methods. Production costs currently run at just over $15 per barrel. Operations are profitable if oil prices remain above $30 a barrel which seems likely in the current geopolitical climate.
The “oil sands” are heavy hydrocarbon deposits that mix bitumen, sand, water, and clay. Bitumen is a heavy, carbon-rich, hydrogen-poor hydrocarbon. The bitumen is upgraded to a cleaner, more fluid product called Syncrude Sweet Blend (SSB) by removing carbon and adding hydrogen. It is then transferred by pipeline to refineries throughout Canada and the United States.

I have not had time to read the information about Peak Oil; I only have my own experience. I believe the Oil Sands have about 4 times as much oil as Saudi Arabia.
Once all the different projects are mined there is about 4,000+ years of oil in the Tundra. I could be very wrong, but if I should be wrong then the Canadian Government will be in for a terrible shock.
Once I have some time I will read the information on the Peak Oil and then reconsider; I may have been brain washed. I know that at this present time here in the Oil Sands we have not even scratched the surface of the possibilities of the Tundra.

Hello Max just a few months ago there was a terrorist attack on the Glasgow Airport. Scottish Police are not armed; there is a special unit who are called out if needed. In Heathrow airport the police there are armed with automatic weapons and walk in pairs. I believe the reason that the Glasgow Airport was the target and not Heathrow is because the Airport is geared more for the locals and tourists. When the terrorists hit the Airport they went through a big glass window and hit a pillar which stopped the vehicle they were driving. The police officer went to assist what he thought was a car accident. He was attacked by the Terrorists and a baggage handler realized what was happening to the Police Officer and went to his aid with some other person. The baggage handler is credited with saving hundreds of lives as everyone was waiting to go onto out going flights. Everyone would have been killed if not for the hero baggage handler. He has been interview and has always maintained he is no hero anyone would have gone to aid the Police officer and would have done the exact same thing that he did. I know these terrorists where not from Glasgow no idea where they came from but they were certainly trying to find a soft target.

Hello Max, I can not fully remember the name of the company but they are in British Columbia, Canada. They have been producing solar powered cars for years but the Canadian Government would not allow this company to sell these vehicles in Canada. This company was allowed to sell their product to other countries and like your post these vehicles where under $20,000:00. I am very happy to see the Canadian Government has come to their senses. I would like to see the government lift this ban off the Solar powered vehicles also.

Hello Pep007 after some reassessments I have decided a steel helmet is called for at this point. I am sorry for the misinformation in my prior post, do everything possible to survive. There is a take no survivors mentality here you are going to be stuffed at any moment now. I will try to protect your back, but no one is taking care of my back so I might not last long…lolol.
