The cases that don't make it to trial are the ones that the SEC has a weak case, like this one.
Highly unlikely because a deal has already been offered. If it does go to trial, it will be about a year from now and the SEC has much bigger fish to fry. That's why most of these cases never get that far.

That was quite some time ago. Actually if the loans are repaid with interest by a stated deadline, no shares are given.
I doubt anyone gets a cut and I don't think any loans are being solicited, but a person can contact Chris for answers by phone, text, email, Facebook, and maybe even Twitter. No need to speculate.
