I am as shocked and surprised by recent news from the FDA, as most of you. However, I don't understand the squabble here. FDA did not say anything was wrong with the device. There was no safety issue. I believe the FDA is saying that:

1. When the company submitted the initial request for approval, they did not provide two separate data for men and women concerning the efficacy of the device. The device was subsequently approved for the knee and foot. Why the FDA did not provide a full clearance at that time is still questionable.
2. When the company submitted the recent request to the FDA, they submitted two separate data for men and women, specifying that the device was more effective for women than men.

Why the company did not specify the efficacy of the device for men and women during the first application when they received the first approval for the knee and foot, but did so on the second request?

The FDA is saying to BIEL, we need more information on why you stated in your request that the device is more effective for women than men. They need more information on men. The problem is did th FDA mention that to the company during the presubmission meeting in May, and they failed to act or they just found out when they received the recent non approval response from the FDA?

I believe we need to be patient and wait for a response from the company to explain what happened and how they plan on fixing the problem moving forward. A lot can happen here without the full FDA clearance. Patience is the key; although, I do understand the great disappointment due to recent news. BIEL is bruised but not dead by far.
