as hashed out here over many weeks months, ,a ban would mean so little since there's so few of the products being sold, now we turn our attention to infringement and damages----and it only last till June 2016---maybe ITC did IDCC a big favor---finally we turn our attention to a real court---
I bet our legal team has been working on the response and appeal for weeks-
If one can prove past infringed patents or patent what's the statue of limitations for those patents/royalties , how long is the look back? I believe BM alluded that they will pursue past infringement royalties, should would be out of the ITC? Correct?
Remember the loss that turned into a win with Huewaii & Samsung, I think the same thing could happen here, in fact they Huewaii--had filed a anti monopoly case and we had lost a ITC case I believe and then in 2 weeks we have road map to settlement, stranger things have happened--
remember the ITC is Yes or NO. we have a lot more options in DE
I partly agree, that's the best way to handle this, in BM comments, collecting on past royalties will only be solved at the Federal court level--correct? The ITC has no jurisdiction over the past royalties--which might be the out for them to just proceed to the District court for remedies---
Lets see there's 3-4 arbitrations in process now, one happens to be the largest company in China...as I said the other day, legal cost is like advertising 50% of it is wasted, you just don't know which 50%....this Nokia suit has been drug out by the ITC and not IDCC--as some have stated the ITC let 2 other cases race ahead and change the rules in midstream for this case---the ALJ seems to have seen the facts and ruled against Nokia--this is now case record---the record matters----
from listening to the last ASM, the board is very pleased with him, not one person make statements such as you make---the past Chairman gave him very high marks-----you seem to be a solo voice crying in the forest-----? have you noticed QCOM trouble of recent---so you would get rid of the Jacobs? good luck with your chainsaw Al mentality---
Ok, so wireless standards are important, since you can't build an eco system without them, IDCC sets on the standards boards world wide.....Nokia has paid IDCC in the past for using its essential standard patents...correct? And now MSFT will have to come to realize that with 10,000 patents remaining , suits are going to be a constant
agenda with them---they have already acknowledged "monopoly " of IDCC....remember in June a judge ruled infringement , reverse hold up---that will happen again in another court

Remember Huawii was a loss than in 3-5 days turned into a win----MSFT must understand that this is not going away..there will be more patents and more litigation for them---

So Microsoft who doesn't pay IDCC anymore is alleging antitrust violation? I wonder how this will be responded to?

I've been pondering how they could split the baby on this one--maybe you have it-----I don't see how they can reverse the remand and go against all the testimony this case has produced--forced arbitration would be fine--but how do they enforce it?

I would agree BUT the filing by MSFT on the anti trust is fishy and smelly , I believe that shows someone figured out this is not going away soon---a hedge possible--but didn't the Huwaeii do the same thing with the Schenzen court in China then they called off the dogs after they agreed to Arbitration?
again an agreement to Arbitrate would be a win for us--and why wouldnt' they agree unless they refuse to pay, again Reverse Hold up--
how can they with a straight face, corporate face have agreed to license the technology then suddenly call off the deal and get take it to the courts? Fishy and smelly
