OT: He's free. They let him out early.
Hey, this is sounding better all the time.
Some of it was misinterpreted. Just because it might have been a "slam dunk," doesn't mean she would rule that day.
If CMKX hadn't shown up in court, she might have ruled yesterday.
Derf, there was no way that the judge was going to rule from the bench.
You should start ending your posts with "flying moose" or something hunnylike.
Fear not. Matt mistakenly sent me a PM that was intended for Valerie. Trust me. We can do whatever we want.
And yet we've been behaving anyway. How disappointing.
Another one bites the dust. Next!
We would have to use our other aliases. Hey, what happened to chwdrhed?
Snackman......he could be our crowning achievement.
Good point.
A great thing about pinkie scams is that not only is there always another one around the corner, the one around the corner is usually even better....but this one sets the bar very high.
A Consent Agreement will kill the appeal option. The lawyers have a cash cow here. We'll see.
If the SEC puts that on the table, I wonder if CMKX will grab it.
Bashers said that the judge would rule from the bench on the first day of the hearing? I missed those.
Perhaps it is because the judge hasn't ruled yet.
That one went straight into Bull's scrapbook.
"As of Dec 2004, 2 trillion shares were issued, and 1.4 trillion shares surrendered, leaving an O/S of approx. 778 billion shares."
I am unable to duplicate that calculation.
After the bombing of Pearl Harbor, a commanding general in California proclaimed that the complete absence of evidence that Japanese-Americans were engaged in sabotage was proof that it was rampant and that they were diabolically clever at it.
You are starting to sound very much like him.
Post that there is a clearly discernible halo over Urbie's head.
Dead for 16 years. Perfect.
Great stuff. "John says the weather is beautiful in L.A. A perfect day for a hearing."
I thought he was in the courtroom.
He's probably off shoving quarters into the Coke machine trying to get a payout.
Did the Urbster show up yet?
I wonder what happened. Did they all take the wrong bus? It matters not. Frizzy and Ferric Oxide Bob can save the day.
Judges just love grandstanding.
Okay. Murray might be the last word for that venue.
Do you happen to know if the SEC has a Judicial Officer who has the final say in any administrative hearing? I know that the USPS does, but it may be something unique to that entity.
As a rule, when faced with the choice of requesting a stay of execution or screaming out "Kill me now!," people tend to opt for the former. And I suspect that UC will never serve as a director of a public corporation again.
I never bought the POS as anything.
Beats me. I'd say that I now believe that through forensic accounting, divine intervention, and other mumbo-jumbo, the records, over time, can be reconstructed accurately enough to be certified. Revocation would cause irreparable harm, so give me a chance.
If that's the case, I'd definitely go with suspension.
I wouldn't say that it's the strongest defense I ever heard. I wouldn't be surprised if they "amended" that stance in court. I sure as hell would.
What is the argument against suspending rather than revoking? Were I the judge, that's what I'd do if it was an option.
"I was wondering if parents could be sued for breach of fiduciary responsibility." Man, I sure hope not.
Sip very slowly.
After they settle on destroying CMKX, they call Greenspan for his okay. He in turn has his wife, Andrea, talk to her people at NBC to kill the Dateline story. It's pretty clear to me.
Legally, it is completely irrelevant. Parading this stuff before a jury is one thing. Parading it before a judge is quite another.
Do you think that CMKX is the first party to pull this stunt? Administrative Law Judges see it all the time.
