A corporation is a standalone entity. Regardless of the improprieties of the Board, the corporation is either bankrupt, or it's not. Given that taxes had been cleared, the bankruptcy judge won't put that on hold until the investigation by the SEC and FBI is done.
So what I am saying is, regardless of the outcome of ATRNQ, there is still the possibility that the Board could be held liable or found guilty of fraud separate from the bankruptcy of the actual business.
Proving that out, going through the process, waiting on that timeline and restitution of these thieves is a whole separate matter from bankruptcy.

AIG Is submitting for payment of either premiums or self insured retentions connected to various actions along with this bankruptcy.
My guess is, AIG is looking for payment of their deductible as it relates to defense payments in all these proceedings (SEC, IRS).

I'm rooting for an SEC investigation that shows that these idiots violated their fiduciary duty to shareholders, their duty of care an duty of loyalty. directors and officers coverage will not cover this type of an activity, because its criminal. if the SEC find these things, presents them to the insurAnce co and carrier denies, then we get to reach into these assholes pockets.
weather we get our money back or not, I'd like to see these people get what they truly deserve. jail time, and public humiliation.

My questions are:
1. How do we vote to turn down this nonsense?
2. What, if anything, is the SEC doing to stop this bull$hit.
3. I do not see that this limits class action capabilities against the BOD. It does, however, limit Iriquious and Hudson Bay's claims against the directors.
