That seems very likely to me.
1) We've read that the common MO of BK's have been to undervalue the estate in order to give equity zero.
2) Susman may have told Rosen that he found the money; plus written evidence that Weil or JPM knows the value is $X.
3) Susman then shows all in the judge's chambers what he has found which then causes very lengthy discussions in chambers.
Perhaps Susman has definitive proof that the estate's value is far above Rosen's value in the DS.
OR perhaps Susman has an email from someone (either Weil or JPM) saying they intend to stonewall the EC or never give the EC all the discovery that Weil/Rosen said they would in open court. This would seem highly relevant to the need for an examiner.
(I might as well speculative like everyone else. LOL)

Actually Rosen has through July 1st.
It is really all working out to be a big game of chicken. Susman is tooling down the road in a Peterbilt with one arm on the wheel and the other with a big fat stogy. Rosen's in a Mini swerving all around trying to intimidate yet he can't stop the inevitable wall coming at him.
I don't think he just wants to delay the examiner but to permanently prevent one by trying to find if Walrath has a lower discovery threshold than what she has previously articulated in court.
I may certainly be wrong and gladly so, but I don't see Rosen improving equity in any POR until he is truly backed against the wall. When he runs out of his bag of tricks an examiner or shareholder vote may certainly do it.
I think it all depends on whether Rosen believes he can prevent an examiner by selling Walrath the BS of his limited discovery to the EC.
Only when Rosen see's no other alternative to prevent an examiner will Rosen really negotiate.

With material changes on or before 7/1 it WILL be considered on 7/8.
With material changes after 7/1 it WILL NOT be considered on 7/8.
With only managerial changes after 7/1 it WILL be considered on 7/8.
Oh.. and the reason I say that is that way there is no "new" cash found. Any big new cash on the table would bring A>L and Weil can't have that.
I think the "wose case" is less likely though. Given Susman's capabilities and our EC I have complete faith in a significant settlement coming our way.
Yes. POR#5 must be file on or before July 1 if there are to be material changes, i.e. something for equity.
At this point, it seems to me that worse case (which isn't bad) for us all is that preferred are assumed 100% by JPM and the commons get a piece of the new commons. Not bad at all.
They may try that but they'll run into a problem.
To get enough to spread around the preferred and commons to make equity happy would be a pretty big hunk of cash. That would beg the question whether higher classes are truly still impaired.
IMO, equity will soon be in the drivers seat.
And we're all glad you did.
And if anyone has a line to the EC, our attorney's should always be the ones to request any and all material presented before the court to be admitted as exhibits.
The article is a little incorrect. Walrath said after July 1st. So they could file on the 1st.
