I have not seen anything to support the accusation that the company expensed gifts given to the Governor. Everything I have seen indicates that the gifts came from JW personally. That being the case, how could there be any liability for the company?

Apparently, Virginia law does not require such gifts to be reported. Therefore there was no improper activity.
I hope you are right. I am an LEF member and spend well over a grand per year on their products. However, I have read articles from LEF in the past where they only had one non-human study to cite on a topic. Yes it was a small part of an article on a broader topic, but they write numerous articles on inflammation where it would be easy to include something on Anatabloc. Anatabloc already has 4 peer reviewed articles. At this point I think it is appropriate to publicly question their motives and ask, "Why the silence?"

I have made repeated but unsuccessful efforts to bring Anatabloc to their attention. So sadly, you may be right.
This has been my second unbelievably blissful spring allergy season with Anatabloc. There is a tremendous market for this purpose if the company can find a way to publicize it.
The authors don't mention anatabine specifically, but the bolded phrase in quote below makes you suspect that they know about it.

Thanks NJ. I had assumed that Star was using some kind of revenue reduction in it's accounting that was impacting their revenue reporting. I did not realize that there is an FASB requirement that necessitated such a revenue reduction.
I do not agree with this FASB requirement. I would much prefer to see the gross revenue and then let the company deduct these items. The FASB is making it much harder for the average investor to evaluate the revenue picture in a fast growing company.
I don't know about "word of mouth" having "1000x the impact". But just becausevthere are studies does not mean every doctor will know. There is a reason why all the drug ads say, "If you have... then ask your doctor about XYZ." Star will need to do some target marketing to Endocrinologist. .

HI Nuke! Thanks for all the time you put in on STSI and for sharing your DD. However, I will disagree with your point #5.
5. Star has been spending ~1.2 Million/qtr on R&D, but a large part of that should be going away now that the ASAP study is finished with the clinical trial portion and the Flint study is also finished. It appears that new studies are being conducted by outside organizations (like Roskamp), so internal R&D expenses should be dropping off significantly in Q4 2012 and Q1 2013 and going forward. I would think Q1 R&D expenses to be down about 50% (to ~600K) compared to Q3 2012 (~$1.2 M).
Star did a press release on the Flint study, botched it and issued a correction. I assume that the Flint study is currently going thru the peer review process which can take months.
Once I found out the protocols for the Flint study, I was not excited by it. That study was for one month off Anatabloc, one month on Anatabloc, and then another month off. That study was designed a couple of years ago as they were just beginning to understand anatabine.
I, and I think many others who are taking Anatabloc, came to the conclusion long ago that our bodies continue to improve the longer we take it. Apparently the results of the 3 month long Human Thyroid study confirm that conclusion.
There are conditions that Anatabloc will address quickly. But I think that there are a far greater number of conditions that just take more time to fully correct. I'm just glad that Anatabloc WORKS! ...However, I would also like to be glad that the share price is at $8 per. I guess that is yet another condition that will "take more time to fully correct."
I have completed a revaluation of my investment in STSI. This is a little early, as I would normally wait for the release of the 2012 Annual Report. But I do not foresee anything in that report that will change my thesis for STSI. I have decided that I will continue adding to my position as opportunity and my finances permit. Further, I think it unlikely that there will be any revelation in the next 12 months that would change that commitment.
I feel for those longs who sold, because I think they gave up too soon. I believe that Star will be profitable in 2013. I also think it highly likely that said profitability will occur early in the year and here's why. (1) The increase in sales evidenced by Chipper's order number tracking on Yahoo. (2) The anecdotal reports of sales increases from those who are visiting GNCs, and (3) I don't think that JW was planning to forego that $1,000,000 salary for very long. I can see the market putting a 40 to 60 PE multiple on a company that has actual revenue growth of 30% (or more) per quarter. That means that even 10 cents per share in annual earnings (total earnings of $16,500,000) would result in a $4 to $6 share price. And with 30% growth per quarter, the share price should continue to increase rapidly after that.
Not contemplated in my thesis is the fact that at some point in all this, the shorts will have to cover. That will be at least an additional 30 million shares of buying that should also serve to increase the share price. But that would be gravy. I believe that increasing revenues and profits will be the driving force for STSI in 2013. Because of that, I have to think that time is growing short for the shorts. As they say on Game of Thrones, "Winter is coming..."
I will continue to monitor this investment for any changes that may impact my reasoning for investing in STSI. But I can be patient, because I know that Anatabloc works! And that word is spreading.
Institutions vs Shorts
The total official short position December 31st was 27,703,666. (Yes that "666" is indication of where this short position originates.)
The total institutional ownership shown on Nasdaq today is 31,741,176 shares. This is not all of them. I think those that are over 5% (i.e. Tradewinds) are not on this list.
The net increase in the short position for the 4th quarter was 644,500 shares. The net increase in institutional ownership in the 4th quarter was 3,175,012 shares. That means the institutional increase was 5 times the amount of the increase in the "official" short position. So where did that other $2.5 million shares bought by institutions come from?
Besides that almost 3.2 million share net increase in institutional holdings, many of us individuals added to our positions in the 4th quarter. So where did all that additional selling come from? There were some individual longs who capitulated, we knew some of them on the MBs as long time longs. But could their shares have numbered in the millions? Or is there really a significant naked position as some have postulated?
The net increase of institutional holdings in the 4th quarter was 3,175,012 shares. There are apparently still 4 or 5 institutions that have yet to report, but the results are unlikely to change significantly at this point. It breaks down as follows:
New positions – 26 Institutions – 1,407,293 shares
Increased - 67 Institutions – 3,352,948 shares
SubTotal – 4,760,241 shares
Sold Out – 16 Institutions – 561,479 shares
Decreased – 38 Institutions – 1,023,750 shares
SubTotal - 1,585,229 shares
28 institutions established new positions in STSI in the 4th quarter. 5 of those came in with over a 100,000 share positions: California Teachers Retirement – 255,700; Talkot Capital – 225,000, JPMorgan Chase – 217,183; Invesco Ltd – 163,148; Group One Trading – 107,248. 67 institutions increased their stake in STSI. 5 of those increased their holdings by over 100,000 shares: Morgan Stanley – 374,588; Vanguard Group – 186,648; Knight Capital – 146,101; Credit Suisse – 135,308; Goldman Sachs – 103,783.
Of the 16 who sold out during the 4th quarter, only two had positions over 100,000 shares: Rex Capital – 120,000; Dimensional Fund – 114,919. Of the 38 who decreased their position, only one was over 100,000 shares. Blackrock Fund sold 176,642 shares, but they still hold 3,062,030 shares.
This is a very encouraging report. This 4th quarter institutional report is where I expected to see the negative fallout from the tobacco settlement. Instead, institutions were substantially increasing their stake in STSI.
