They seemed to have amended all their filings just recently. Nothing substantial, so what could be the reasoning?

Strange they are asking for only 400 million more instead of the 5 billion + they need. Are they making money now, such that they only need to satisfy the reserve requirements? Either way, they need to divulge their status and future plans, in their own best interest.
I was commenting on hearing from Bob, not the content of his message. He may be more upbeat about Kiwa now, as opposed to the past.

"During three months ended March 31, 2009, the Purchasers converted $79,455 principal and nil interest into 193,504,557 shares of our common stocks. As of March 31, 2009, face amount of convertible notes outstanding was $1,542,868."
I can't picture them sitting on shares, they want their money.
AF-01 deal could be a restricted stock.
New financing to cover the bad debt is imperative. Stall on Ribotski until that happens.

Realize it was the 1st quarter 10Q that was released. It is now June. Fertilizer sales pick up heavily in Spring, when planting starts. I recall a post a few weeks back with a comment from Kiwa that sales were doing well. They also may be further along than we think with financing.
All the 8K says is that R's group formally filed a notice to the SEC stating that Kiwa has not filed their quarterly. This we are all aware of already. It must precede their next step on the road to collecting at the end of the month. They could have filed the same form when the annual became overdue months ago. There is no definitive resolution yet. Not enough info.

IMHO, the last couple days MM's have been on the bid, but not on the ask. They are setting up for a run.
The L2 market depth positioning gives me the impression some MM's are loading up for a bigger jump than the normal turnover.

If Kiwa files a quarterly report, then things must be improving drastically (toxic financing gone, sales up, AF-01 initial investment) for them or else why would they bother to file with Ribotsky's death spiral financing due and little to no money for an audit to satisfy shareholders, that will get them nothing?
IMHO, you're right, they'll file by months end.
He really can't say too much one way or another until Kiwa tells him to. At least, the reports from various news sources in Chinese gov't. point to something positive.

That's part of the fun on these public boards. Every comment is either a bash or pump. We are all guilty of bashing or pumping relevant to another. The challenge is to read between the lines and decide for yourself, for if you follow anothers advice solely, you will be sorry.

Sorry, my bad. Should have said (800,000)*433= 346.4 mil.

There were 433 listed as shareholders of common stock in the annual, I believe. That averages around 8 mil. apiece, obviously some a lot more or less. With that, some people have a nice chunk invested and are willing to hold out until news is released on financing and AF-01 progress.

If they do get the Ribski financing dealt with by using govt. money, they would be foolish to raise the AS with the share price where it is. They wouldn't bring in much. My guess would be they finally do some heavy PR to get the share price up, then ask to bump up the AS, to bring in more money and pay down their debt. By that time, there would be enough interest to maintain the share price while diluting. They wouldn't need a large increase in AS to cover part of the debt. Or, they are able to pay off their debt doing business and don't ask to raise the AS.
